Disertační práce s názvem "Úprava soudního tlumočení a překladu ve veřejném právu a její vliv na právo na tlumočení" se zaměřuje na analýzu a hodnocení mechanismů, které mají zajistit rovný přístup ke spravedlnosti prostřednictvím kvalitního soudního tlumočení a překladu. Výchozím bodem je ústavně zaručené právo na tlumočení, jak vyplývá z čl. 37 odst. 4 Listiny základních práv a svobod, a jeho interpretace v kontextu mezinárodních dokumentů, zejména směrnice 2010/64/EU, jež stanoví, že kvalita tlumočení a překladu musí umožnit spravedlivé vedení řízení. První část disertační práce analyzuje legislativní rámec soudního tlumočení a překladu v České republice, přičemž se zaměřuje na zákon č. 354/2019 Sb., o soudních tlumočnících a soudních překladatelích (TlumZ), a jeho implementaci do praxe. Zkoumá právní záruky zajišťující kvalitu tlumočení a překladu a hodnotí jejich účinnost ve vztahu k právu na tlumočení. Součástí analýzy je rovněž srovnání s právními úpravami ve vybraných evropských státech - v Belgii, Francii a na Slovensku - a identifikace možných inspirativních prvků pro českou právní úpravu, jako je přísnější ověřování odborné způsobilosti, systém dočasného zápisu či závazný etický kodex. The doctoral thesis entitled 'Regulation of Judicial Interpretation and Translation in Public Law and its Impact on the Right to Interpretation' focuses on the analysis and evaluation of mechanisms to ensure equal access to justice through quality judicial interpretation and translation. The starting point is the constitutionally guaranteed right to interpretation, as derived from article 37(4) of the Charter of Fundamental Rights and Freedoms, and its interpretation in the context of international instruments, in particular Directive 2010/64/EU, which states that the quality of interpretation and translation must enable the fair conduct of proceedings. The first part of the dissertation analyses the legislative framework of court interpreting and translation in the Czech Republic, focusing on Act No. 354/2019 Coll., on Court Interpreters and Court Translators, and its implementation in practice. It examines the legal guarantees ensuring the quality of interpreting and translation and assesses their effectiveness in relation to the right to interpretation.
