Výjimky z povinnosti podat předběžnou otázku dle čl. 267 SFEU ve světle aktuální judikatury SDEU a ÚS Abstrakt Diplomová práce se zaměřuje na výjimky z povinnosti podat předběžnou otázku podle třetího pododstavce článku 267 Smlouvy o fungování Evropské unie (SFEU). Tato povinnost, jejímž cílem je zajistit jednotný výklad a aplikaci unijního práva, je jedním z klíčových prvků soudní spolupráce mezi Soudním dvorem Evropské unie (SDEU) a vnitrostátními soudy členských států. Zároveň však může být zdrojem napětí, zejména vůči ústavním soudům, jejichž úkolem je chránit ústavnost a základní práva v národním právním řádu. Jádrem práce jsou tzv. CILFIT kritéria, formulovaná SDEU v rozsudku ve věci CILFIT z roku 1982, která vymezují situace, v nichž se může soud členského státu Evropské unie, jehož rozhodnutí nelze napadnout opravnými prostředky podle vnitrostátního práva, zdržet předložení předběžné otázky. Práce zkoumá vývoj těchto kritérií v kontextu změn v evropské soudní hierarchii, rostoucího množství členských států a rozšiřujících se pravomocí unijních institucí. Pozornost je věnována také rozsudku ve věci Consorzio Italian Management, v němž SDEU tato kritéria částečně aktualizoval, a stanovisku generálního advokáta Bobka, které navrhovalo jejich zásadní reformu. Exceptions to the duty to submit a preliminary reference under Article 267 TFEU according to current case law of the CJEU and the Czech Constitutional Court Abstract The thesis focuses on exceptions to the duty to refer a question for a preliminary ruling under the third subparagraph of Article 267 of the Treaty on the Functioning of the European Union (TFEU). This obligation, which aims to ensure the uniform interpretation and application of EU law, is one of the key elements of judicial cooperation between the Court of Justice of the European Union (CJEU) and the national courts of the Member States. At the same time, however, it can be a source of tension, particularly with regard to constitutional courts, whose task is to protect constitutionality and fundamental rights in the national legal order. Crucial to this thesis are the so-called CILFIT criteria, formulated by the CJEU in its 1982 judgment in the CILFIT case, which define situations in which a court of an EU Member State, against whose decisions there is no judicial remedy under national law, may refrain from referring a question to the CJEU. The thesis examines the development of these criteria in the context of changes in the European judicial hierarchy, the growing number of Member States, and the expanding powers of EU institutions....
