1 Kasační závaznost nálezů Ústavního soudu v trestních věcech Abstrakt Diplomová práce se zabývá institutem kasační závaznosti nálezů Ústavního soudu v trestním řízení, a to jak z pohledu normativního, doktrinálního a judikaturního, tak i na základě empirického zkoumání soudní praxe. Práce vychází z ústavního zakotvení závaznosti nálezů v čl. 89 odst. 2 Ústavy České republiky a analyzuje jeho konkrétní dopady na rozhodování obecných soudů po zrušení jejich rozhodnutí Ústavním soudem. Autor podrobně rozebírá ustanovení § 314h odst. 1 trestního řádu, které stanoví tři základní podmínky kasační závaznosti v trestních věcech: pokračování řízení ve stadiu, které zrušenému rozhodnutí bezprostředně předcházelo (nestanoví- li nález jinak), vázanost právním názorem Ústavního soudu a povinnost provést nařízené úkony či doplnění dokazování. Empirická část práce analyzuje 79 řízení z let 2021 a 2022, v nichž Ústavní soud zasáhl do probíhajícího trestního řízení. Výsledky ukazují, že obecné soudy ve valné většině případů podmínky kasační závaznosti naplňují. Účinnost zásahu Ústavního soudu z hlediska ochrany práv stěžovatele, měřená změnou výsledku řízení, byla prokázána v 61,5 % případů. Klíčovým zjištěním však je, že případy, v nichž nedošlo ke změně výsledku řízení navzdory zrušujícímu nálezu Ústavního soudu, nelze... 1 The Binding Effect of Constitutional Court Judgments in Criminal Cases Abstract The thesis deals with the concept of the binding effect of Constitutional Court judgments in criminal cases, examining it from normative, doctrinal, and jurisprudential perspectives, as well as through empirical analysis of judicial practice. The thesis builds on the constitutional foundation of the binding nature of Constitutional Court judgments as established in Article 89(2) of the Constitution of the Czech Republic and analyzes its specific implications for the decision-making of ordinary courts after their rulings have been quashed by the Constitutional Court. The author provides a detailed analysis of Section 314h(1) of the Criminal Procedure Code, which defines three fundamental conditions for the binding effect in criminal matters: the continuation of proceedings at the stage immediately preceding the annulled decision (unless the judgment of the Constitutional Court provides otherwise), the obligation to respect the legal opinion of the Constitutional Court, and the duty to carry out the ordered procedural steps and evidentiary supplements.
