Osobnostní práva autorská a jejich vývoj po dobu trvání autorskoprávní ochrany Abstrakt Diplomová práce se zamYuje na komplexní analýzu osobnostních práv autorských a jejich vývoje bhem celé doby trvání autorskoprávní ochrany. Práce systematicky zkoumá obsah, povahu a promny tchto práv od vzniku díla, pYes jejich uplatnní za ivota autora, a po posmrtné posobení vybraných dosledko. Cílem práce je zachytit a vylo it asovou dynamiku osobnostních práv autorských, vymezit jejich podstatné znaky a mechanismy výkonu a vyhodnotit jejich promítání do jednotlivých fází ochrany v etn posmrtné roviny. Za pou ití analytické a komparativní metody jsou závry zasazeny do rámce vnitrostátní a evropské právní úpravy a sou asné judikatury. Práce je koncipována jako postupné vymezení od obecného ke specifickému. Úvodní ásti mapují systém práv k nehmotným statkom a historický vývoj autorského práva od starovku po sou asnost, v etn vývoje v eské republice. Následuje analýza prameno autorského práva na mezinárodní, evropské a národní úrovni. Teoretický rámec vymezuje autorské právo v objektivním i subjektivním smyslu a rozdlení na osobnostní a majetkovou slo ku. It systematically examines the content, nature, and evolution of these rights from the creation of a work, through their exercise during the author9s lifetime, to the posthumous protection of selected aspects. The aim is to capture and explain the temporal dynamics of moral rights, to define their essential features and mechanisms of exercise, and to assess how they operate across the successive phases of protection, including the posthumous dimension. Using analytical and comparative methods, the conclusions are situated within the national and European legal framework and contemporary case law. The thesis proceeds from the general to the specific. The introductory parts map the system of rights in intangible assets and the historical development of copyright from antiquity to the present, including developments in the Czech Republic. This is followed by an analysis of the sources of copyright at the international, European, and national levels.
