1 Abstrakt Předkládaná diplomová práce poskytuje čtenáři analýzu problematických aspektů účastenství. Jedná se o komplikovaný právní institut, který bývá označován spolu se souběhem za nejsložitější problematiku trestního práva hmotného. Cílem práce je zaměřit se na problematické aspekty tohoto institutu. Práce se zaměřuje na problematiku vyplývající z platné úpravy, aplikační praxe a výkladu právních norem. Rozbor tohoto složitého trestněprávního institutu se jen těžko obejde bez teoretických základů, vyjasnění pojmosloví a alespoň letmého nastínění historických souvislostí, které formovaly tento institut a vedly až k přijetí současné úpravy. První část diplomové práce vymezuje pojmy související s trestnou součinností a účastenstvím, které rozebírá jako pojem v užším i širším smyslu, pojednává též o pojmech obligatorního a eventuálního účastenství, přičemž tato práce je zaměřena na eventuální účastenství. Druhá část diplomové práce se věnuje teoretickým přístupům k trestné součinnosti. Nejprve se věnuje pojetí pachatele v užším a širším pojetí. V kapitole Pachatel a trestná součinnost podle monistického a dualistického systému jsou rozebrány dva stěžejní přístupy k trestání účastenství, a to monistický a dualistický systém, též nazývány jako systém unitární a diferencovaný. Zejména pro dualistický systém... 1 Abstract The submitted thesis provides the reader with an analysis of problematic aspects of participation. It concerns a complex legal institution, which, along with concurrence of offences, is considered one of the most complicated issues of substantive criminal law. The aim of this thesis is to focus on the problematic aspects of this institution. The thesis concentrates on issues arising from the applicable legislation, the application practice, and the interpretation of legal provisions. An analysis of this complex criminal law institution can hardly be carried out without theoretical foundations, clarification of terminology, and at least a brief outline of the historical context that shaped this institution and led to the adoption of the current regulation. The first part of the thesis defines concepts related to criminal cooperation and participation, discussing them as concepts in both the narrow and broader sense, and also addresses the notions of obligatory and eventual participation, with this thesis focusing on eventual participation. The second part of the thesis is devoted to theoretical approaches to criminal cooperation. It first deals with the concept of the perpetrator in both its narrow and broader understanding.
