Předmětem této diplomové práce je právní úprava obnovitelných zdrojů energie se zaměřením na využití slunečního záření. Obnovitelné zdroje energie představují jeden ze zásadních nástrojů pro naplňování klimaticko-energetických cílů, a to jak na úrovni práva Evropské unie, tak i na úrovni vnitrostátní. Práce si klade za cíl analyzovat právní rámec České republiky v oblasti obnovitelných zdrojů energie, zejména ve vztahu k fotovoltaickým elektrárnám a posoudit, do jaké míry současná právní úprava vytváří příznivé podmínky pro jejich rozvoj. Vzhledem k tomu, že se Česká republika významně orientuje na využívání energie ze slunečního záření, věnuje se tato práce také právním aspektům využívání tohoto zdroje, včetně procesu výstavby fotovoltaických elektráren. Diplomová práce je rozdělena do pěti hlavních kapitol. První kapitola se zabývá jednotlivými obnovitelnými zdroji energie a vysvětluje důležitost jejich integrace do právních řádů, a to i v kontextu mezinárodního práva. Druhá kapitola je věnována právu Evropské unie, neboť to je zcela klíčové pro naši vnitrostátní právní úpravu a ovlivňuje řadu zásadních institutů. Třetí kapitola se věnuje hlavním pramenům českého právního řádu v oblasti obnovitelných zdrojů energie a navazujícím strategickým dokumentům. Čtvrtá a pátá kapitola se již podrobně... The subject of this thesis is the legal regulation of renewable energy sources with a focus on the use of solar radiation. Renewable energy sources represent one of the key instruments for achieving climate and energy goals, both at the level of European Union law and at national level. The aim of the thesis is to analyse the legal framework of the Czech Republic in the field of renewable energy sources, especially with regard to photovoltaic power stations and to assess to what extent the current legislation creates favourable conditions for their development. As the Czech Republic has a strong focus on the use of solar energy, this thesis also focuses on the legal aspects of the use of this energy source, including the legal regulation of the construction process of photovoltaic power stations. The thesis is divided into five main chapters. The first chapter deals with individual renewable energy sources and explains the importance of their integration into legal systems, including in the context of international law. The second chapter is devoted to the law of the European Union, as it is quite crucial for our national legislation and affects a number of fundamental institutes.
