Nejlepší zájem dítěte a mediace, platná právní úprava a výhledy do budoucna Diplomová práce se zabývá principem nejlepšího zájmu dítěte v kontextu rodinného práva a jeho uplatněním v rámci mediace. Cílem práce je analyzovat právní ukotvení tohoto principu na národní i mezinárodní úrovni, objasnit jeho význam, vývoj a roli při rozhodování soudů ve věcech týkajících se dítěte, a zhodnotit možnosti a limity využití mediace v rodinných sporech. Práce se soustředí zejména na otázky participace dítěte, zapojení orgánů sociálně- právní ochrany dětí a specifika mediace při rozvodech a rozlukách. Na základě právní analýzy a dostupné judikatury jsou v závěru navržena doporučení de lege ferenda, směřující ke zvýšení efektivity a dětských práv šetřícího přístupu při řešení konfliktů v rodině. The aim is to analyse the legal framework of this principle at both national and international levels, to explain its significance, development, and role in judicial decision-making in matters involving children, and to evaluate the opportunities and limitations of mediation in family disputes. The thesis focuses in particular on the participation of the child, the role of the child protection authority (OSPOD), and the specific features of mediation in divorce and separation cases. Based on legal analysis and case law, the thesis concludes with de lege ferenda recommendations aimed at promoting more effective and child-friendly approaches to conflict resolution within the family.
