Právní analýza likvidace klášterů v Československu v padesátých letech dvacátého století Abstrakt Cílem této disertační práce je právněhistorická analýza zásahů, které stranické a státní orgány učinily v letech následujících po převzetí moci komunistickou stranou v Československu proti mužským řeholním řádům a kongregacím. Práce se věnuje přípravě a průběhu "akce K", tedy nezákonné likvidaci mužských klášterů, ke které došlo v průběhu dubna a počátkem května roku 1950, odvlečení členů takto likvidovaných mužských řeholních řádů do koncentračních táborů a nezákonného omezení osobní svobody řeholníků v těchto táborech. Práce se skládá z úvodu, dvou částí a závěru. První část nazvaná Příprava na likvidaci klášterních komunit začíná analýzou událostí, které se udály po komunistickém puči v únoru roku 1948 a mají vztah k poměru nově etablovaného totalitního komunistického státu a církve. Je zde popisováno omezování náboženských svobod a postupné rušení autonomie církví a náboženských společností. V této části práce jsou rovněž analyzovány nejvýznamnější právní předpisy, které komunistická moc přijala za účelem utvrzení svého postavení a používala k represáliím svých odpůrců. Samostatná kapitola této části práce je věnována způsobu přijetí a dopadům dvojice proticírkevních zákonů, a sice zákona č. 217/1949 Sb., o... Legal analysis of the liquidation of monasteries in Czechoslovakia in the 1950s Abstract The aim of this thesis is a legal-historical analysis of interventions made by party and state authorities in the years following the takeover of power by the Communist Party in Czechoslovakia against male religious orders and congregations. The thesis is devoted to the preparation and course of "action K", i.e. the illegal liquidation of men's monasteries, which took place during April and early May 1950, the deportation of members of the destroyed male religious orders to concentration camps and the illegal restriction of their personal freedom in these camps. The thesis consists of an introduction, two parts and a conclusion. The first part, entitled Preparation for the destruction of monastic communities, begins with an analysis of the events that took place after the communist coup in February 1948 and are related to the relationship between the newly established totalitarian communist state and the church. It describes the restriction of religious freedoms and the gradual cancellation of the autonomy of churches and religious societies.
