[cze][eng] Diplomová práce se zabývá možností zavedení daně z nerealizovaných zisků v České republice. Teoretická část se opírá o ekonomické a právní vymezení klíčových pojmů jako příjem, hodnota a realizace zisku. V další části práce je provedena komparativní analýza zahraničních přístupů, zejména ze Spojených států, Francie a Německa, včetně posouzení ústavních aspektů, metod výpočtu základu daně a mechanismů řešení likvidity. Zvláštní pozornost je věnována kompatibilitě daně s právem Evropské unie a existujícím prvkům českého daňového práva, které fakticky vedou ke zdanění nerealizovaných výnosů. Závěrečná část obsahuje návrh daně de lege ferenda. Práce dospívá k závěru, že za splnění určitých podmínek lze tuto daň v českém právním prostředí úspěšně implementovat.The thesis deals with the possibility of introducing a tax on unrealised profits in the Czech Republic. The theoretical part is based on the economic and legal definition of key concepts such as income, value and realisation of profit. In the next part of the thesis, a comparative analysis of foreign approaches, in particular from the United States, France and Germany, is carried out, including an assessment of constitutional aspects, methods of calculating the tax base and mechanisms for dealing with liquidity. Particular attention is paid to the compatibility of the tax with EU law and existing elements of Czech tax law that effectively lead to the taxation of unrealised gains. The final part contains a de lege ferenda tax proposal. The thesis concludes that under certain conditions this tax can be successfully implemented in the Czech legal environment.
