Postavení mediátora - vnitrostátní a mezinárodní perspektiva Abstrakt Diplomová práce se zabývá právní úpravou postavení mediátora v České republice, a to se zaměřením na její srovnání v rámci středoevropského právního prostoru. Mediátor představuje klíčového aktéra mediace. Způsob, jakým je jeho postavení upraveno, má tedy zásadní vliv na celkovou podobu tohoto alternativního způsobu řešení sporů a může významně ovlivnit míru jeho využití v praxi. Cílem předkládané diplomové práce je proto zodpovědět otázku, zda současná česká právní úprava postavení mediátora představuje dostatečně kvalitní rámec pro budoucí rozvoj a širší využití mediace. Pro zodpovězení této otázky je v první části diplomové práce analyzován současný legislativní rámec postavení mediátora v České republice. Úvodní kapitola se zabývá jednotlivými režimy, v nichž lze mediaci podle českého právního řádu vykonávat. Od následující kapitoly se již analýza zabývá výlučně režimem zapsaného mediátora, který představuje základní a zároveň nejpodrobněji upravený režim poskytování mediačních služeb. Pozornost je věnována především podmínkám, které musí zájemci o výkon této činnosti splnit, aby se mohli stát zapsanými mediátory. The Status of the Mediator - National and International Perspectives Abstract This thesis examines the legal framework governing the status of the mediator in the Czech Republic, with a particular focus on its comparison within the Central European legal context. The mediator is a key actor in the mediation. The manner in which the mediator's status is regulated has a fundamental impact on the overall functioning of this alternative dispute resolution method and can significantly influence the extent of its practical use. The primary objective of this thesis is therefore to answer the question of whether the current Czech legal regulation of the mediator's status provides a sound framework for the future development and broader application of mediation. To address this question, the first part of the thesis analyses the current legislative framework of the mediator's status in the Czech Republic. The introductory chapter focuses on the various legally recognized regimes under which mediation may be conducted according to Czech law. The subsequent chapters deal exclusively with the regime of the registered mediator, which constitutes the primary and most comprehensively regulated form of providing mediation services.
