Výpověď jako způsob skončení nájmu bytu v České republice Abstrakt Tato diplomová práce se zaměřuje na výpověď jako způsob skončení nájmu bytu v České republice. Cílem práce je podat ucelený výklad právní úpravy výpovědi z nájmu bytu, a to z pohledu jak hmotného, tak i procesního práva. Práce objasňuje základní pojmy, analyzuje jednotlivé výpovědní důvody a upozorňuje na praktické problémy, které v souvislosti s ukončením nájemního vztahu výpovědí nastávají. Institut nájmu bytu je významným nástrojem občanského práva pro zajištění bytové potřeby nájemce, přičemž samotná výpověď představuje jeden z klíčových právních mechanismů jeho ukončení. Práce se věnuje i dopadům výpovědi na postavení nájemce a pronajímatele, jakož i přesahům do dalších oblastí práva, zejména práva procesního. Cílem je nabídnout čtenáři přehlednou a prakticky využitelnou analýzu výpovědi jako formy skončení nájmu bytu. První část práce se věnuje obecnému institutu nájmu a následně specifikům nájmu bytu. Zvláštní pozornost je zaměřena na charakteristiku bytu jako předmětu nájmu, náležitosti nájemní smlouvy, práva a povinnosti smluvních stran a přehled jednotlivých způsobů zániku nájemního vztahu. Druhá část práce se soustředí výhradně na výpověď jako specifický způsob ukončení nájmu bytu. Podrobně je rozebrána jak výpověď ze strany... Notice as a Method of Terminating the Lease of an Apartment in the Czech Republic Abstract This thesis focuses on notice as a method of terminating the lease of an apartment in the Czech Republic. The aim is to provide a comprehensive interpretation of the legal regulation governing termination of the tenancy relationship by notice, addressing both substantive and procedural aspects. The thesis defines key legal terms, analyses individual statutory grounds for notice-based termination, and highlights practical issues that commonly arise in this context. The lease of an apartment is an important civil law instrument for securing a tenant's housing needs, while notice represents one of the fundamental legal mechanisms for bringing the tenancy relationship to an end. The thesis also examines the legal effects of termination on both the tenant and the landlord and considers overlaps with other areas of law, particularly procedural law. The objective is to offer a clear and practically applicable analysis of notice as a form of terminating the lease of an apartment. The first part of the thesis outlines the general concept of lease and then focuses on the specifics of residential lease contracts.
