Psychologické aspekty procesu hodnocení důkazů Abstrakt Tato diplomová práce zkoumá psychologické jevy ovlivňující soudce při rozhodování se zaměřením na proces hodnocení důkazů. Diplomová práce také porovnává výsledky zahraničních empirických studií a jakým způsobem mohou tyto psychologické jevy ovlivnit soudní rozhodování. Cílem práce je seznámení s problematikou vlivu psychologických jevů na činnost soudců, se zaměřením na hodnocení důkazů v rámci soudního procesu, a také poskytnutí návrhu některých protiopatření, které jsou vhodné k omezení či odstranění vlivu těchto psychologických jevů na soudce. První část diplomové práce se věnuje způsobu rozhodování soudce a intuici, která otevírá prostor pro potencionální zkreslení. V druhé a třetí části jsou popisovány jednotlivé psychologické jevy a zkoumány empirické studie, které se na tyto jevy zaměřují. Zkoumanými jevy jsou zejména implicitní předsudky a kognitivní zkreslení, ale také emoce a heuristiky. Ve čtvrté části jsou doporučeny protiopatření, prostřednictvím kterých lze vliv těchto jevů omezit či eliminovat. V závěru diplomová práce potvrzuje vliv psychologických jevů na soudce a také klade důraz na fakt, že zkoumání vlivu těchto jevů na české soudce je oblastí neprozkoumanou. Psychological aspects of evidence evaluation Abstract This diploma thesis examines the psychological phenomena that influence judges during decision-making, with a focus on the process of evaluating evidence. The thesis also compares the findings of foreign empirical studies and explores how these psychological phenomena can affect judicial decision-making. The goal of the thesis is to provide insight into the influence of psychological phenomena on the work of judges, with focus on evidence evaluation within a judicial proceeding, and to propose certain countermeasures suitable for reducing or eliminating the influence of these phenomena on judges. The first part of the thesis discusses the decision-making process of judges and the role of intuition, which opens the door to potential biases. The second and third parts describe individual psychological phenomena and examine empirical studies that focus on these phenomena. The examined phenomena include primarily implicit biases and cognitive distortions, but also emotions and heuristics. The fourth part recommends countermeasures that may help mitigate or eliminate the influence of these effects.
