Tato diplomová práce se zaměřuje na konstrukci domácího násilí v soudních rozsudcích, které se týkají tohoto genderově podmíněného násilí. Cílem práce je prostřednictvím feministické kritické diskurzivní analýzy zjistit, jak soudy domácí násilí konstruují, jak genderově podmíněné stereotypy a mocenské aspekty ovlivňují rozhodovací procesy soudců a jak tyto faktory souvisejí s ukládáním podmínečně odložených trestů pachatelům. Práce zahrnuje analýzu vybraných rozsudků a identifikaci vzorců v argumentaci, přičemž se zaměřuje na to, jakým způsobem jsou genderové stereotypy ve vztahu k rolím mužů a žen zohledňovány při posuzování vybraných případů Tato studie si klade za cíl poskytnout hlubší porozumění roli genderového řádu a mocenských struktur v rámci soudního systému. Zjištěné poznatky mohou přispět k širší diskusi o spravedlnosti a rovnosti před zákonem a nabídnout podněty ke zlepšení praxe v případech domácího násilí. Through feminist critical discourse analysis, the thesis aims to explore how courts construct domestic violence, how gendered stereotypes and power considerations influence judges' decision-making processes, and how these factors relate to the imposition of suspended sentences on offenders. The paper includes an analysis of selected sentences and the identification of patterns in the reasoning, focusing on how gender stereotypes in relation to gender roles are taken into account when considering selected cases. This study aims to provide a deeper understanding of the role of gender order and power structures within the judicial system. The findings may contribute to the broader debate on justice and equality before the law and offer suggestions for improving practice in domestic violence cases.
