1 Abstrakt Tato rigorózní práce se zaměřuje na téma skončení pracovního poměru s těhotnou zaměstnankyní. Jejím cílem bylo poskytnout ucelený soubor informací a úvah týkajících se problematiky skončení pracovního poměru s těhotnou zaměstnankyní a ochrany těhotné zaměstnankyně v souvislosti s tímto skončením tak, jak jsou upraveny v právním řádu i judikatuře České republiky a Evropské unie. Rovněž dojít k závěru, zda je aktuální právní úprava adekvátní potřebné ochraně těhotné zaměstnankyně a po provedeném zjištění případně nabídnout vhodné změny zákona de lege ferenda. Práce je rozdělena do čtyř částí, které jsou dále členěny na jednotlivé kapitoly a podkapitoly. První část práce nabízí úvod do celé problematiky ochrany těhotné ženy v zaměstnání. V první kapitole je vymezen základní pojem těhotenství, v kapitole druhé je prostor věnován těhotenství, jakožto předmětu právní ochrany vnitrostátních i mezinárodních právních předpisů. Kapitola třetí se vypořádává s obecným pojetím právní ochrany těhotné zaměstnankyně a rozděluje ji do tří oblastí na právní ochranu při výkonu práce, při změnách nebo v souvislosti se změnami pracovního poměru a ve vztahu ke skončení pracovního poměru. Poslední kapitola první části práce je zaměřena na právní úpravu týkající se informování o těhotenství a oznamování těhotenství... 1 Abstract This rigorous thesis focuses on the topic of termination of employment with a pregnant employee. Its aim was to provide a comprehensive set of information and considerations regarding the issue of termination of employment with a pregnant employee and the protection of a pregnant employee before and in connection with this termination, as regulated in the legal system and case law of the Czech Republic and the European Union. The aim was also to conclude whether the current legal regulation is adequate to the necessary protection of a pregnant employee and offer appropriate amendments de lege ferenda, if necessary. The thesis is divided into four parts, which are further divided into individual chapters and subchapters. The first part of the thesis offers an introduction to the entire issue of protection of pregnant women at work. The first chapter defines the basic concept of pregnancy, and the second chapter devotes space to pregnancy as a subject of legal protection in national and international legislation. Chapter three deals with the general concept of legal protection of pregnant employees and divides it into three areas: legal protection during work, during changes or in connection with changes in the employment and against the termination of the employment.
