Diplomová práce "Pracovní povinnost v proměnách času z právněhistorické perspektivy" se zabývá fenoménem pracovní povinnosti a jejím zakotvením v právněhistorické perspektivě s přihlédnutím k vývoji v rámci soudobé tuzemské historiografie. Text diferencuje dvojí základní pojetí pracovní povinnosti, a to v závislosti na způsobu jejího legislativního vyjádření. Jedná se konkrétně o explicitní a implicitní pracovní povinnost, přičemž implicitní formu lze dále členit na generální (ve vztahu k institutu příživnictví) a individuální (ve vztahu k institutu pracovní kázně). V nastíněném smyslu se text diplomové práce nejprve blíže věnuje regulaci explicitní pracovní povinnosti od vzniku samostatné ČSR, a to v průběhu období první a druhé republiky, protektorátu Čechy a Morava a v navazující raně poválečné éře. Následně se vlastní pozornost práce obrací k implicitní pracovní povinnosti, a to v kontextu jednak lidově-demokratického a jednak navazujícího socialistického státního zřízení. Předestřenou optikou je analyzován trestněprávní institut příživnictví a materiálně související pracovněprávní institut (socialistické) pracovní kázně. Příslušné kapitoly předkládaného textu prezentují, jakým způsobem se proměňovalo vnímání pracovní povinnosti ve vymezených etapách tuzemských soudobých dějin prostřednictvím... The thesis "Labour Duty in the Changes of Time from a Legal-Historical Perspective" deals with the phenomenon of labour duty and its embedding in a legal-historical perspective, taking into consideration the development within the contemporary national historiography. The text differentiates the two basic conceptions of the labour duty, depending on the way it is expressed in legislation. Specifically, these are explicit and implicit labour duties, while the implicit form can be further subdivided into general (in relation to the conception of social parasitism) and individual (in relation to the conception of labour discipline). In the outlined sense, the text of the thesis first examines the regulation of the explicit labour duty since the establishment of the independent Czechoslovakia, namely during the First and Second Republics, the Protectorate of Bohemia and Moravia, and in the subsequent early post-war era. The thesis then turns its own attention to the implicit work duty, in the context of both the people's democratic and the subsequent socialist state system. The criminal law conception of social parasitism and the materially related labour law conception of (socialist) labour discipline are analysed through the lens presented.
