Česká republika před Evropským soudem pro lidská práva Abstrakt Tato diplomová práce analyzuje rozhodnutí Evropského soudu pro lidská práva (ESLP) týkající se České republiky, konkrétně případy D. H. a ostatní proti České republice a Vavřička a ostatní proti České republice. Cílem je prozkoumat zapojení České republiky do systému ochrany lidských práv poskytované ESLP, a zanalyzovat širší kontext předmětných rozhodnutí, včetně jejich právních a společenských dopadů. Metodologicky práce využívá komparativní právní analýzu zahrnující porovnání právních úprav v rámci Evropy, a dále rozbor argumentace ESLP, aplikovaných právních principů a důsledků předmětných rozhodnutí. Vedle právní analýzy zohledňuje i empirická data a odborné studie reflektující dopady rozsudků. Případ D. H. a ostatní proti České republice řešil systémovou diskriminaci romských dětí v přístupu ke vzdělání. ESLP poprvé konstatoval, že i formálně neutrální opatření mohou mít diskriminační dopady. Rozhodnutí vedlo k dlouhodobým debatám o reformě českého vzdělávacího systému a ke změnám v legislativě směřujícím k inkluzivnějšímu vzdělávání. Přesto však přetrvávají otázky ohledně reálné implementace těchto opatření a jejich účinnosti v praxi. Případ Vavřička se týkal povinného očkování a otázky rovnováhy mezi individuálními právy a ochranou... The Czech Republic before the European Court of Human Rights Abstract This thesis analyses the decisions of the European Court of Human Rights (ECHR) concerning the Czech Republic, specifically the cases of D. H. and others v. Czech Republic and Vavřička and others v. Czech Republic. The goal is to examine the Czech Republic's involvement in the system of human rights protection provided by the ECtHR, and to analyse the broader context of the decisions in question, including their legal and social implications. Methodologically, the thesis uses a comparative legal analysis, including a comparison of legal arrangements within Europe, and an analysis of the ECHR's reasoning, the legal principles applied and the implications of the decisions in question. In addition to the legal analysis, it also takes into account empirical data and expert studies reflecting the impact of the judgments. The case of D. H. and Others v. Czech Republic addressed systemic discrimination against Roma children in access to education. The ECHR found for the first time that even formally neutral measures can have discriminatory effects. The decision led to long-standing debates on reforming the Czech education system and changes in legislation towards more inclusive education. Nevertheless, questions remain about the actual...
