Práce popisuje změny procesu mezinárodní normotvorby v období od založení OSN do souasnosti a zejm. postavení a roli Šestého výboru Valného shromáždění v tomto procesu. První kapitola objasňuje základní otázky mezinárodní normotvorby (druhy normotvorby, autonomní a heteronomní normotvorbu, jevy progresivního rozvoje mezinárodního práva a jeho kodifikace a jejich historii atd.) a dělí normotvorný proces do pěti fází (průzkumná, přípravná, deliberaní, rozhodovací, ratifikaní). Druhá kapitola se zabývá průzkumnou a přípravnou fází normotvorného procesu, v nichž dominuje Komise pro mezinárodní právo. V souvislosti s tím analyzuje souasný stav vztahu Komise a Šestého výboru a jeho příiny a ukazuje, jak vlivem innosti Komise do mezinárodní normotvorby pronikají prvky heteronomie. Třetí kapitola se věnuje postavení a innosti Šestého výboru a s tím související deliberaní a rozhodovací fází normotvorného procesu. Mj. i na třech případových studiích ukazuje, v em Šestý výbor selhává, resp. v em lze spatřovat naději na revitalizaci jeho innosti. tvrtá kapitola struně hodnotí roli Mezinárodního soudního dvora v normotvorbě. Autor dochází k závěru, že souasný stav mezinárodní normotvorby charakterizovaný neinností Šestého výboru, snahou Komise pro mezinárodní právo o maximalizaci svého vlivu na... The dissertation delves into the evolution of the international law-making process since the establishment of the United Nations, with a particular emphasis on the role and function of the Sixth Committee of the General Assembly in this context. The initial chapter delineates the foundational principles of international law-making, encompassing the categories of law- making, the distinction between autonomous and heteronomous law-making, the progressive development of international law and its codification, and the historical context. The subsequent chapter is devoted to a comprehensive analysis of the law-making process, which is divided into five phases: exploratory, preparatory, deliberative, decision-making, and ratification. The second chapter focuses on the exploratory and preparatory phases of the law-making process, which are predominantly influenced by the International Law Commission. In this context, the chapter analyzes the current state of the relationship between the Commission and the Sixth Committee, exploring the underlying causes and the pervasion of elements of heteronomy in international law-making through the Commission's activities.
