Disparita podílů při vypořádání společného jmění manželů Abstrakt Tématem rigorózní práce je disparita podílů při vypořádání společného jmění manželů se zaměřením na povahu jednotlivých pravidel disparity v zákonné úpravě, jejich výklad a přístup soudní praxe k těmto pravidlům, a konečně také srovnání těchto pravidel s úpravou vypořádání dvou základních manželských majetkových režimů dle německé právní úpravy. Kromě stávající právní úpravy je pozornost věnována také aktuální novele občanského zákoníku v souvislosti s potíráním domácího násilí, kterou dochází k doplnění úpravy disparity. Cílem rigorózní práce je popsat a analyzovat stávající zákonnou úpravu disparity včetně jejího budoucího, novelizovaného znění, rozebrat jednotlivá pravidla disparity, jejich vzájemnou souvislost a přístup judikatury k aplikaci těchto pravidel, a rovněž zhodnotit, zda tato úprava vede ke spravedlivému vypořádání společného jmění manželů. Cílem je také provést komparaci české právní úpravy disparity s německou úpravou vypořádání manželských majetkových poměrů a nalézt v obou úpravách podobnosti či odlišnosti stran disparity při vypořádání. Proto rigorózní práce na úvod analyzuje povahu pravidel disparity z hlediska právní teorie, popisuje základní východiska a historický vývoj právní úpravy disparity. Dále podrobně rozebírá... Disparity of shares in the settlement of the matrimonial property Abstract The topic of this thesis is the disparity of shares in the settlement of the matrimonial property, focusing on the nature of individual disparity rules in statutory regulations, their interpretation and the approach of judicial practice to these rules, and finally a comparison of these rules with the settlement of two basic matrimonial property regimes under German law. In addition to the existing legal regulation, attention is also paid to the current amendment to the Civil Code in connection with the fight against domestic violence, which supplements the regulation of disparity. The aim of this thesis is to describe and analyse the current legal regulation of disparity, including its future amended wording, to analyse the individual rules of disparity, their interrelationship and the approach of case law in relation to the application of these rules, and to assess whether this regulation leads to a fair settlement of the matrimonial property. The aim is also to compare the Czech legal regulation of disparity with the German regulation of the settlement of matrimonial property relations and to find similarities or differences between the two regulations in terms of disparity in settlement.
