Policejní odposlechy a jejich užití v aplikační praxi Abstrakt Předmětem této rigorózní práce je problematika policejních odposlechů a jejich užití v aplikační praxi. Rigorózní práce definuje limity vedení trestního řízení a související základní předpoklady pro zásahy do základních práv a svobod dotčených osob, v kontextu policejních odposlechů. Základem práce je vymezení legálních a teoretických koncepcí policejních odposlechů a jejich propojení s aplikační, respektive rozhodovací praxí orgánů veřejné moci. V této souvislosti práce objasňuje a vysvětluje základní instituty a pojmy spojené s touto problematikou, zejména v podobě odposlechu a záznamu telekomunikačního provozu, zjišťování údajů o telekomunikačním provozu, operativně pátracích prostředků, sledování osob a věcí a prostorových odposlechů. Pozornost je věnována též příkazu k odposlechu, povolení k realizaci prostorového odposlechu a použitelnosti a užití záznamů z odposlechů v rámci trestního řízení. Práce taktéž analyzuje a srovnává jednotlivé druhy odposlechu mezi sebou a dále též českou právní úpravu odposlechu a záznamu telekomunikačního provozu s právní úpravou slovenskou. Legální a teoretické koncepce policejních odposlechů, které jsou v práci blíže rozvedeny, jsou následně propojovány s rozhodovací praxí Ústavního soudu a některých soudů... Police wiretapping and their use in application practice Abstract The subject of this rigorous thesis is the issue of police wiretapping and its use in application practice. The thesis defines the limits of conducting criminal proceedings and the related basic prerequisites for interference with the fundamental rights and freedoms of the persons concerned, in the context of police wiretapping. The basis of the thesis is the definition of legal and theoretical concepts of police interceptions and their connection with the application or decision-making practice of public authorities. In this context, the thesis clarifies and explains the basic institutes and concepts related to this issue, especially in the form of interception and recording of telecommunication traffic, detection of data on telecommunication traffic, operational search means, surveillance of persons and things and spatial interception. Attention is also paid to the warrant for interception, the authorization for the implementation of spatial interception and the applicability and use of interception records in criminal proceedings.
