Konsenzuální způsoby řešení trestních věcí Abstrakt Diplomová práce se zabývá dílčími aspekty procesních institutů, které jsou souhrnně označované jako konsenzuální způsoby řešení trestních věcí. Cílem práce je analyzovat vliv novely trestního řádu provedené zákonem č. 333/2020 Sb. na základní zásady trestního řízení v obecné rovině, tedy z hlediska dopadu zakotvení příslušných konsenzuálních forem na koncepci trestního řízení v ČR. Práce si zároveň klade za cíl posoudit vliv těchto procesních institutů na jednotlivé dotčené základní zásady trestního řízení. Diplomová práce je členěna do čtyř kapitol. První kapitola diplomové práce se věnuje shrnutí základních charakteristik modelů trestního řízení v anglosaském a kontinentálním právním systému a následně krátce pojednává o nejednoznačné povaze smíšeného modelu trestního procesu a o prolínání prvků inkvizičního a adversárního trestního řízení, kdy toto téma lze s přihlédnutím k vývoji českého trestního řízení v posledních desetiletích považovat za relevantní pro koncepci trestního procesu v ČR. Ve druhé kapitole jsou rozebírány vybrané aspekty zavedení konsenzuálních způsobů řešení trestních věcí do trestního řízení. Tato kapitola krátce pojednává o vývoji právní úpravy konsenzuálních institutů v českém právním řádu a následně se soustředí přímo na novelu... Consensual Ways of Processing Criminal Cases Abstract The thesis deals with particular aspects of procedural institutes, which are collectively referred to as consensual ways of processing criminal cases. The objective of the thesis is to analyse the impact of the amendment to the Code of Criminal Procedure made by Act No. 333/2020 Coll. on the basic principles of criminal procedure in general, i.e. in terms of the impact of the introduction of the relevant consensual procedures on the concept of criminal proceedings in the Czech Republic. The thesis also aims to assess the impact of these procedural institutes on the individual basic principles of criminal proceedings concerned. The thesis is divided into four chapters. The first chapter of the thesis is devoted to a summary of the basic characteristics of the models of criminal procedure in the Anglo-Saxon and Continental legal systems and then briefly discusses the ambiguous nature of the mixed model of criminal procedure and the intermingling of elements of inquisitorial and adversarial criminal procedure, where this topic can be considered relevant to the concept of criminal procedure in the Czech Republic, taking into account the development of Czech criminal procedure in recent decades.
