Právní aspekty (registrovaného) partnerství a právní postavení dítěte Abstrakt Diplomová práce se zabývá právními aspekty stejnopohlavního formálního soužití a právním postavením dítěte, a to nikoli pouze v kontextu novely občanského zákoníku. Cílem práce je především analýza současné podoby homosexuálních rodin, včetně možných přístupů k rodičovství. Vyhodnocení probíhalo na základě komparace partnerství, registrovaného partnerství a manželství, a to se zřetelem k zásadě nediskriminace a právu na ochranu rodinného života. Diplomová práce se zaměřuje nejen na institucionální soužití osob stejného pohlaví, ale taktéž na možnosti uplatnění jejich reprodukčních práv a jiných přístupů k rodičovství, včetně úvah de lege ferenda a zhodnocení dosavadního právního stavu napříč Evropskou unií. První část práce obsahuje tři kapitoly, přičemž se zabývá stejnopohlavními svazky. První kapitola představuje institut registrovaného partnerství a partnerství, včetně jejich legislativního vývoje a diskriminačního kontextu. V druhé kapitole je věnována pozornost komparaci manželství, partnerství a registrovaného partnerství z hlediska dílčích právních aspektů. Obsahem třetí kapitoly je demonstrace a zhodnocení právního stavu v Evropské unii. Druhá část práce se zaměřením na právní postavení homosexuálních rodin z hlediska... Legal aspects of a (registered) partnership and the legal status of the child Abstract The Master's Thesis deals with the legal aspects of same-sex formal cohabitation and the legal status of the child, not only in the context of the amendment to the Civil Code. The main aim of the Thesis is to analyse the current form of homosexual families, including possible approaches to parenthood. The evaluation was carried out on the basis of a comparison of partnership, registered partnership and marriage, taking into account the principle of non-discrimination and the right to protection of family life. The Master's Thesis focuses not only on the institutional cohabitation of same- sex couples, but also on the possibilities of exercising their reproductive rights and other approaches to parenthood, including de lege ferenda considerations and an assessment of the current legal situation across the European Union. The first part of the Thesis contains three chapters, and deals with same-sex unions. The first chapter introduces the institution of a registered partnership and partnership, including their legislative development and discriminatory context.
