78 Vady při skončení pracovního poměru Abstrakt Ve své diplomové práci nazvané "Vady při skončení pracovního poměru" autorka rozebírá instituty zdánlivosti spolu s absolutní a relativní neplatností v kontextu skončení pracovního poměru. Poukazuje přitom ale i na některé mezery ve výkladu zejména institutu zdánlivosti, které byly v nedávné době vyplněny judikaturou. Dále rozebírá, jaké následky má neplatné a zdánlivé skončení pracovního poměru, a to jak z hmotněprávního, tak z procesněprávního hlediska. Tyto následky následně porovnává mezi sebou a upozorňuje na některé zvláštnosti, které působí tyto dva instituty vedle sebe. Tato diplomová práce má tedy za cíl sumarizaci informací zabývající se úpravou vad při skončení pracovního poměru se zaměřením se zejména na otázku aplikačních důsledků institutů zdánlivosti a neplatnosti a v kontextu skončení pracovního poměru také načrtnout postupy, jakými je možné minimalizovat rizika jak pro zaměstnance, tak pro zaměstnavatele. Diplomová práce je členěna do pěti hlavních kapitol. V první kapitole autorka rozebírá problematiku charakteristiky pracovního poměru, jeho vzniku, změny a zejména pak jeho zániku. Druhá kapitola se věnuje neplatnosti skončení pracovního poměru, přičemž tento institut popisuje jak z obecného pohledu občanského zákoníku, tak z pohledu lex... 79 Defects of termination of employment Abstract In this thesis entitled "Defects of termination of employment" the author analyses the institutes of nullity together with absolute and relative invalidity in the context of termination of employment. In doing so, the author also points out several gaps in the interpretation of the institute of illusory effect, which have been filled by recent case law. This thesis also analyses the consequences of invalid and void termination of the employment relationship, both from a substantive and procedural point of view. It then compares these consequences with each other and draws attention to some of the particularities that these two institutes have alongside each other. Thus, the thesis aims to summarize the information concerning the regulation of defects in the termination of employment, focusing in particular on the question of application consequences of the institutes of invalidity and nullity. Furthermore, in the context of termination of employment, this work shall also outline the procedures by which the risks for both the employee and the employer can be minimized.
