Právo na odpor a občanská neposlušnost v judikatuře soudů a v právní praxi Abstrakt Diplomová práce pojednává o dvou významných právních institutech s tradicí, která dalece přesahuje náš současný právní řád. I přes tuto skutečnost se jedná o nepříliš hojně využívané právní nástroje, ačkoliv zejména občanská neposlušnost v poslední době získává na rozmachu. Právo na odpor a občanská neposlušnost jsou příbuzné právní pojmy, avšak s podstatnými rozdílnostmi. V úvodní části této diplomové práce se představuje právo na odpor z pojmového hlediska, které v průběhu dějin mělo rozličnou podobu. Souhrnným způsobem je prezentován navazující dějinný vývoj v různých historických etapách na odlišných místech světa. Posléze je upřena pozornost na pozitivně právní zachycení práva na odpor v českém ústavním pořádku s vymezením podmínek pro ústavně souladnou aplikaci. Úvodní teoretické seznámení s právem na odpor je zakončeno jeho vymezením ve vztahu nejen k občanské neposlušnosti, ale i dalším právním nástrojům. Druhá část této práce se věnuje užití práva na odpor pohledem konkrétních případů, o kterých rozhodovaly nejvýše postavená soudní tělesa české justice. Ve druhé polovině této diplomové práce dostává prostor občanská neposlušnost. Nejdříve dochází k jejímu vytýčení s uvedením možných teoretických východisek a... The Right to Resistance and Civil Disobedience in the Jurisprudence of the Courts and in Legal Practice Abstract The thesis deals with two important legal institutes with a tradition that goes far beyond our current legal system. In spite of this fact, these are not widely used legal instruments, although civil disobedience in particular has been gaining momentum recently. The right to resistance and civil disobedience are related legal terms, but with significant differences. The introductory part of this thesis introduces the right to resistance from a conceptual point of view, which has taken different forms throughout history. The subsequent historical development in different historical stages in different parts of the world is presented in a summary manner. Afterwards, the attention is focused on the positive-legal capture of the right to resistance in the Czech constitutional order with the definition of conditions for constitutionally consistent application. The initial theoretical introduction to the right to resistance is concluded with its definition in relation not only to civil disobedience but also to other legal instruments.
