Řešení obchodních a sportovních sporů s mezinárodním prvkem v rozhodčím řízení Abstrakt Tato diplomová práce se zabývá komparativní analýzou řešení sporů v rámci dvou vybraných národních fotbalových asociací - Fotbalové asociace České republiky (FAČR) a Anglické fotbalové asociace (The FA). Cílem práce je analyzovat právní rámec rozhodčího řízení v těchto asociacích a jejich vztah k Mezinárodnímu arbitrážnímu soudu pro sport (CAS). Vzhledem k tomu, že FAČR a The FA operují v odlišných právních prostředích - kontinentálním systému versus common law - práce zkoumá, jak tyto rozdíly ovlivňují průběh a strukturu rozhodčího řízení v každé z asociací. Z analýzy vyplývá, že rozhodčí řízení FAČR je problematické z hlediska své právní povahy. Sbor rozhodců FAČR sice funguje jako rozhodčí orgán, avšak jeho status je sporný s ohledem na judikaturu Nejvyššího soudu ČR, který jej označil za rozhodčí komisi spolku, a tudíž podléhající omezením stanoveným občanským zákoníkem. Oproti tomu rozhodčí řízení The FA odpovídá standardnímu arbitrážnímu procesu dle britského Arbitration Act. Strany zde mají větší procesní volnost, rozhodnutí jsou jednoinstanční a konečná, přičemž rozhodčí doložky inkorporované do stanov asociace byly britskými soudy uznány jako platné a závazné. Resolving commercial and sports disputes with an international element in arbitration Abstract This thesis focuses on a comparative analysis of dispute resolution within two selected national football associations - the Football Association of the Czech Republic (FAČR) and the English Football Association (The FA). The objective of the study is to analyze the legal framework of arbitration proceedings within these associations and their relationship with the Court of Arbitration for Sport (CAS). Given that FAČR and The FA operate in different legal environments - the continental system versus common law - the thesis examines how these differences influence the course and structure of arbitration proceedings in each association. The analysis reveals that FAČR's arbitration proceedings are problematic in terms of their legal nature. Although FAČR's Arbitration Board functions as an arbitral body, its status is disputed due to the jurisprudence of the Supreme Court of the Czech Republic, which classified it as an arbitration committee of an association, thereby subjecting it to the limitations imposed by the Civil Code. In contrast, arbitration under The FA follows a standard arbitral process in accordance with the UK Arbitration Act. Parties have greater procedural flexibility, decisions are single- instance...
