Předkládaná diplomová práce se zabývá srovnáním judikatury Evropského soudu pro lidská práva a Soudního dvora Evropské unie v oblasti práva na spravedlivý proces. Jejím cílem je porovnat rozhodovací činnost obou evropských soudů s ohledem na základní aspekty spravedlivého řízení, a to zejména v časovém období mezi roky 2018 a 2022. Uvedeny jsou nejen odlišnosti, ale také případy, v nichž se oba evropské soudy ve svém rozhodování shodují. Práce je rozdělena na dvě části. V rámci teoretické části se nejprve krátce věnuje systému ochrany základních práv Evropské unie a systému ochrany lidských práv Rady Evropy. V první kapitole jsou blíže rozvedeny některé otázky týkající se působnosti a aplikovatelnosti Listiny základních práv a svobod Evropské unie a je objasněn její vztah k Evropské úmluvě o ochraně lidských práv a základních svobod a vnitrostátním katalogům základních práv. Následně se tato kapitola zaměřuje na vývoj v přístupu Soudního dvora k ochraně základních práv v Evropské unii a současnou úroveň jejich ochrany. Zmíněn je také vztah Soudního dvora a vnitrostátních soudů. Druhá kapitola pojednává o Evropské úmluvě o ochraně lidských práv a základních svobod a o Evropském soudu pro lidská práva. Vyjasňuje vzájemný vztah mezi oběma evropskými soudy a zkoumá vliv Evropské úmluvy o ochraně... The present thesis deals with a comparison of the case law of the European Court of Human Rights and the Court of Justice of the European Union in the area of the right to a fair trial. Its aim is to compare the decision-making of both European courts with regard to the fundamental aspects of fair trial, in particular in the time period between the years 2018 and 2022. Not only the differences are mentioned, but also the cases in which both European courts agree in their decisions. The thesis is divided into two parts. The theoretical part first briefly discusses the European Union's system of fundamental rights protection and the Council of Europe's system of human rights protection. The first chapter elaborates on some issues concerning the scope and applicability of the Charter of Fundamental Rights and Freedoms of the European Union and clarifies its relationship to the European Convention on Human Rights and national catalogues of fundamental rights. This chapter then looks at the evolution of the Court's approach to the protection of fundamental rights in the European Union and describes the current level of their protection.
