[cze][eng] Virtuální vlastnictví: alternativa k licenčním smlouvám a smlouvám o poskytování digitálního obsahu Abstrakt Předmětem této práce je virtuální vlastnictví jakožto předmět, respektive potenciální předmět, právních vztahů, a to ve zúženém rozsahu videoherního prostředí. Hlavním cílem práce je indukce definičních znaků virtuálního vlastnictví, popis jeho významu, analýza jeho hodnoty a následné návrhy de lege ferenda. Navzdory rozsáhlým diskusím na toto téma zůstává budoucnost virtuálního vlastnictví nejasná. Autor v práci rozebírá odbornou literaturu na téma virtuálního vlastnictví a souvisejících témat z virtuálního prostředí. Tato diplomová práce analyzuje postavení virtuálního vlastnictví v kontextu současných právních institutů, zejména licenčních smluv a smluv o poskytování digitálního obsahu, které jsou mnohdy společně obsaženy ve smíšených smluvních podmínkách poskytovatelů služeb. Oba tyto instituty jsou v práci detailně rozebrány s důrazem na práva a povinnosti stran v rámci právních vztahů jimi založených. Také jsou rozebrány vybrané v praxi užívané smluvní podmínky předních provozovatelů videoher či videoherních platforem. Na těchto je s přihlédnutím k odborné literatuře popsána aktuální smluvní praxe, která je založena na adhezních smíšených smlouvách paušálně vylučujících potenciální práva...Virtual property: an alternative to license agreements and contracts for the supply of digital content Abstract The subject of this thesis is virtual property as an object, or a potential object, of legal relationships, in the narrowed scope of the video game environment. The main objective of the thesis is to induce the definitional features of virtual property, describe its importance, analyze its value, and then come up with suggestions de lege ferenda. Despite extensive discussions on the topic, the future of virtual property remains unclear. In this paper, the author discusses literature on virtual property and related topics from the virtual environment. This thesis analyses the position of virtual property in the context of current legal institutes, in particular license agreements and contracts for the supply of digital content, which are often jointly contained in mixed service provider contracts. Both of these institutes are discussed in detail in the thesis, with an emphasis on the rights and obligations of the parties within the legal relationships based on them. Selected contract terms used in practice by leading video game or video game platform operators are also discussed.
