Online platforms are an increasingly important part of the EU economy. As a rule, they act as intermediaries between the platform user and a third party who subsequently provides the service requested by the user. However, there is no physical contact between the platform and its user. All their legal actions are carried out through electronic means of communication. As online platforms are a relatively new phenomenon, there is still a degree of uncertainty about the legal rules that apply to their activities. The key EU norms on the provision and free movement of services that are relevant in the context of online platforms have been presented. These are Article 56 of the Treaty on the Functioning of the European Union, the Services directive, and the E-commerce directive. The Court of Justice of the European Union has addressed the nature of online platforms and the rules that may apply to their activities in several of its decisions concerning Uber and Airbnb. The main criterion in examining the nature of online platforms has been the degree of control that a particular online platform has over the part of the service that is provided to the end customer offline. Online platformy jsou stále významnější součástí ekonomiky Evropské unie. Zpravidla vystupují jako zprostředkovatelé mezi uživatelem platformy a třetí osobou, která uživatelem požadovanou službu následně poskytne. Mezi platformou a jejím uživatelem však nedochází k žádnému fyzickému kontaktu a veškerá jejich právní jednání jsou činěna prostřednictvím prostředků elektronické komunikace. Protože jsou online platformy relativně novým fenoménem, dosud panuje nejistota ohledně právních norem, které na jejich činnost dopadají. Byly představeny hlavní prameny unijní právní úpravy týkající se poskytování a volného pohybu služeb, které v kontextu online platforem připadají v úvahu. Jedná se o článek 56 Smlouvy o fungování Evropské unie, směrnici o službách, a e-commerce směrnici. Soudní dvůr Evropské unie se charakterem online platforem a předpisy, které se na jejich činnost mohou aplikovat, zabýval v několika svých rozhodnutích týkajících se platforem Uber a Airbnb. Hlavní kritérium při zkoumání charakteru online platforem byla míra kontroly, kterou konkrétní online platforma má nad částí služby, která je poskytována koncovému zákazníkovi offline.
