Trestněprávní souvislosti povinné mlčenlivosti vybraných profesí Rigorózní práce je rozdělena do devíti kapitol. První kapitola pojednává o státem uznané a zákonem uložené povinnosti mlčenlivosti ve vztahu k regulovaným profesím a trestnímu právu. Rozveden je účel institutu povinnosti zachovávat mlčenlivost, zejména ochrana vztahu důvěrnosti mezi poskytovatelem služeb, příjemcem a s ní související ochrana soukromí a osobních údajů. V rámci této kapitoly jsou rozvedena práva a zejména povinnosti vyplývající z trestních předpisů, a to jak z trestního práva hmotného - povinnost oznámit a překazit trestný čin, tak procesního - povinnost součinnosti v trestním řízení, podání vysvětlení, svědecká povinnost, jakož i zákaz výslechu a odepření výpovědi. Druhá kapitola je věnována povinné mlčenlivosti zdravotníků a částečně také sociálních pracovníků; zabývá se vymezením mlčenlivosti poskytovatelů zdravotních služeb, jejím vývojem, zákonnými výjimkami, trestněprávními souvislostmi, vymezením některých subjektů poskytujících zdravotní péči a zdravotnickou dokumentací, jež představuje stěžejní dokument při poskytování zdravotních služeb. Podkapitola je rovněž vyčleněna k otázce subsidiarity trestní represe ve vztahu k porušení povinnosti mlčenlivosti a trestní odpovědnosti za neoprávněné nakládání s osobními... Criminal law implications of mandatory confidentiality of selected professions The thesis explores the criminal law implications of mandatory confidentiality across nine comprehensive chapters. The first chapter deals with the legally mandated confidentiality recognized by the state and law as it pertains to regulated professions within the realm of criminal law. It addresses the fundamental purpose of confidentiality, which aims to safeguard the confidential relationship between service providers and recipients, alongside the protection of privacy and personal data. This chapter further elucidates both the rights and obligations arising from criminal law, distinguishing between substantive obligations - such as the duty to report and prevent crimes - and procedural obligations, which include the duty to cooperate in criminal proceedings, the duty to provide explanations, the duty to give evidence, as well as the prohibitions on interrogation and the right not to testify. The second chapter deals with the mandatory confidentiality imposed on healthcare professionals and, to some extent, on social workers. It provides a detailed analysis of the concept of confidentiality within healthcare, tracing its evolution, identifying statutory exceptions, and examining its intersection with criminal law....
