[cze][eng] Cílem této rigorózní práce bylo zodpovědět několik otázek, konkrétně zda je judikatura Ústavního soudu ohledně platových restrikcí soudců ustálená a zda je judikatura Ústavního soudu ohledně platových restrikcí soudců v souladu s mezinárodními prameny soft law a judikaturou Evropského soudu pro lidská práva a Soudního dvora Evropské unie. V závěru jsme zjistili, že judikatura Ústavního soudu týkající se platových restrikcí soudců je relativně ustálená, neboť z osmi hlavních tezí se Ústavní soud odchýlil pouze od dvou, přičemž tyto dvě teze byly navíc z pohledu autora této rigorózní práce problematické. Na druhou stranu Ústavní soud aplikoval většinu jím vyslovených tezí, na kterých se později ustálil, bez zřejmého důvodu s velikým zpožděním. To platí o druhé, čtvrté, páté, šesté a osmé tezi. Ústavní soud také své ustálené teze často opomněl zohlednit, byť se v daném případě aplikace takové teze přímo nabízela. To platí o první, druhé a páté tezi. V recentních nálezech Platy soudců XVII, XVIII a XIX byl Ústavní soud spíše konzistentní s prvky inovace, neboť se v těchto se právě odchýlil od třetí a šesté teze. Judikatura Ústavního soudu týkající se platových restrikcí soudců je v souladu s mezinárodními prameny soft law a s judikaturou Evropského soudu pro lidská práva a Soudního dvora Evropské unie....The aim of this rigorous thesis was to answer several questions, namely whether the case law of the Constitutional Court regarding salary restriction judges is constant and whether the case law of the Constitutional Court regarding salary restriction judges is in accordance with international sources of soft law and the case law of the European Court of Human Rights and the Court of Justice of the European Union. In conclusion, we found that the case law of the Constitutional Court regarding salary restriction judges is relatively established, because out of the eight main theses, the court deviated from only two, and these two theses were also problematic from the perspective of the author of this rigorous thesis. On the other hand, the Constitutional Court applied most of the theses it expressed, on which it later settled, without apparent reason and with a great delay. This applies to the second, fourth, fifth, sixth and eighth theses. The Constitutional Court also often neglected to take its established theses into account, even if they were directly offered in the case of the application of such a thesis.
