Osud tzv. černých a některých dalších staveb Abstrakt Tato diplomová práce se zaměřuje na problematiku neoprávněných staveb ve smyslu veřejného práva. Autor práce se zabývá pojmem stavby ve smyslu nového Stavebního zákona, povolovacích procesů, prostřednictvím kterých stavebníci získají oprávnění zřídit stavbu, teoretického vymezení neoprávněné stavby ve smyslu veřejného práva s poukazem na rozdělení neoprávněných staveb podle jejich vzniku na tzv. černé stavby a tzv. zčernalé stavby. Dále autor popisuje rozdělení neoprávněných staveb podle jejich typů, na řízení o nařízení odstranění stavby, podmínky dodatečného povolení stavby a opakované povolení. Autor ve vybraných částech práce srovnává novou právní úpravu se starou právní úpravou, popisuje pozitivní změny, které nový Stavební zákon přinesl oproti staré právní úpravě a zároveň se zaměřuje na potenciální slabá místa nové právní úpravy, která mohou v praxi činit problémy. Tato práce je strukturována do pěti částí, přičemž první část se zaměřuje zejména na definování pojmu stavby ve smyslu veřejného stavebního práva. Tato část je zaměřena rozbor definice stavby v novém Stavebním zákoně, popsání znaků stavby, které vychází přímo ze zákonné definice stavby a znaků, které dovozuje judikatura a odborná literatura. The fate of so-called black buildings and some other buildings Abstract This thesis focuses on the issue of unauthorized buildings in the context of public law. The author examines the concept of building as defined by the new Building Act, the permitting processes through which builders obtain the right to establish a building, and the theoretical definition of unauthorized building in terms of public law, highlighting the classification of unauthorized buildings based on their origin into so-called "black buildings" and "gray buildings." Furthermore, the author describes the classification of unauthorized buildings by their types, the proceedings for ordering the removal of buildings, the conditions for obtaining retrospective permits, and repeated permits. In selected parts of the thesis, the author compares the new legal regulation with the old legal regulation, describing the positive changes brought by the new Building Act compared to the old one, while also focusing on potential weaknesses of the new regulation that may pose practical problems. This work is structured into five parts, with the first part primarily focusing on defining the concept of building in terms of public building law.
