Aspekty práva na spravedlivý proces v řízeních před spolkovými orgány Fotbalové asociace České republiky Tato diplomová práce se zabývá aspekty práva na spravedlivý proces v řízeních před spolkovými orgány Fotbalové asociace České republiky (FAČR). Práce analyzuje, jak jsou jednotlivá řízení, ať již disciplinární nebo rozhodčí (včetně řízení odvolacích) strukturována, a hodnotí jejich soulad s požadavky na spravedlivý proces dle českého i mezinárodního práva, včetně Úmluvy o ochraně lidských práv a základních svobod. Zaměřuje se na procesní pravidla stanovená Disciplinárním řádem a Procesním řádem FAČR, včetně otázek dokazování, nezbytnosti dodržení spravedlivého procesu uvnitř spolku, aplikace právních zásad práva na spravedlivý proces, průběhu samotných řízení a míry autonomie spolku při přezkumu rozhodnutí orgánu spolku soudy (vnitrostátními i mezinárodními). Práce konkrétně popisuje disciplinární řízení před Etickou komisí FAČR a rozhodovací procesy Odvolací komise. Diskutuje specifické problémy, jako je možnost trestat nečleny spolku či využití důkazů získaných v trestním řízení. Poukazuje současně na rozpory mezi Etickou a Odvolací komisí. Důraz je kladen rovněž i na proporcionalitu ukládaných sankcí a roli druhé instance při zajištění nápravy chyb v rozhodování. Mimo vybrané formy... Aspects of the right to a fair trial in proceedings before the federal bodies of the Football Association of the Czech Republic This thesis deals with aspects of the right to a fair trial in proceedings before the federal bodies of the Football Association of the Czech Republic (FACR). The thesis analyses how individual proceedings, whether disciplinary or arbitration (including appeals), are structured and assesses their compliance with the requirements of a fair trial under Czech and international law, including the Convention for the Protection of Human Rights and Fundamental Freedoms. It focuses on the procedural rules set out in the Disciplinary Rules and the Procedural Rules of the FACR, including issues of evidence, the necessity to observe due process within the association, the application of legal principles of the right to a fair trial, the conduct of the proceedings themselves and the degree of autonomy of the association in reviewing the decisions of the association's body by the courts (both national and international). The thesis specifically describes the disciplinary proceedings before the FACR Ethics Committee and the decision-making processes of the Appeals Committee.
