Právně-teoretická koncepce vztahu veřejného zájmu a individuálních práv (na příkladu vyvlastnění kulturních památek) Abstrakt Tato diplomová práce se zabývá právně-teoretickým výkladem vztahu mezi veřejným zájmem a individuálními právy. V první části je analyzován historický vývoj koncepcí vlastnictví a veřejného zájmu v evropském právně-filozofickém myšlení. Práce se věnuje římskoprávní tradici, přirozenoprávním teoriím (včetně Grotia a Locka), utilitarismu, teoriím Immanuela Kanta a Georga Hegela a teorii lidského rozvoje. Důraz je kladen na dvě klíčové problematiky, které tvoří průřezové téma celé práce. První z nich je otázka vztahu jednotlivce a společnosti - tedy zda a v jakém rozsahu může být jedinec v právním státě zavázán k odpovědnosti vůči komunitě, a jak tuto odpovědnost právně uchopit bez popření individuální autonomie. Druhou rovinou je napětí mezi pluralitním pojetím hodnot, které uznává různorodost legitimních veřejných zájmů, a monistickými teoriemi, které usilují o univerzální a pevně dané vymezení a hierarchii obecných hodnot. Tyto konflikty mají zásadní význam pro interpretaci hranic a legitimity zásahů do vlastnických práv. Stěžejní část práce se věnuje právě těmto otázkám na pozadí různých právních teorií. V závěru je jako konkrétní oblast, kde se tyto konflikty zřetelně promítají,... 1 The Legal-Theoretical Relationship Between Public Interest and Individual Rights: The Case of Cultural Heritage Expropriation Abstract This thesis explores the legal-theoretical relationship between public interest and individual rights. The first part examines the historical development of the concepts of ownership and public interest in European legal and philosophical thought. The thesis focuses on the Roman law tradition, natural law theories (including Grotius and Locke), utilitarianism, the philosophies of Immanuel Kant and Georg Hegel, and the theory of human flourishing. Special attention is paid to two central issues that form a recurring theme throughout the work. The first is the question of the relationship between the individual and society-namely, whether and to what extent a person can be held responsible toward the community in a constitutional state, and how such responsibility can be expressed in legal terms without negating individual autonomy. The second issue concerns the tension between pluralist value theories, which recognize the diversity of legitimate public interests, and monist approaches that seek a universal and fixed definition and hierarchy of common values.
