Úřad evropského veřejného žalobce začal svou činnost vykonávat 1. června 2021. Do té doby byl výzkum tohoto nového unijního orgánu zaměřen primárně na nařízení Rady (EU) 2017/1939 ze dne 12. října 2017, kterým se provádí posílená spolupráce za účelem zřízení Úřadu evropského veřejného žalobce, případně na směrnici (EU) 2017/1371 ze dne 5. července 2017 o boji vedeném trestněprávní cestou proti podvodům poškozujícím finanční zájmy Unie, která definuje věcnou příslušnost Úřadu. V současnosti je už však možné se zaměřit na to, jak Úřad funguje v praxi a s jakými překážkami se reálně potýká. V původních výzkumech odborníci odhalili řadu potenciálních problémů, kterým Úřad bude muset čelit. Nyní, po více než třech letech jeho činnosti, je možné zjistit, zda se ve svých predikcích mýlili, či nikoli. Cílem této disertační práce je proto odpovědět na otázku, zda a jak se Úřad v praxi vypořádal s potenciálními problémy a nejasnostmi, které byly v minulosti identifikovány. Za tím účelem je výzkum rozdělen do pěti základních oblastí, kterými jsou organizační záležitosti, absence harmonizace trestněprávních předpisů, přezkum činnosti, přeshraniční vyšetřování a vnější justiční spolupráce. V rámci každé oblasti byl definován jeden nebo více potenciálních problémů, které mohou mít vliv na efektivitu Úřadu. Za... The European Public Prosecutor's Office ("the EPPO") started its activities on 1st June 2021. Until then, research on this new EU body had focused primarily on Council Regulation (EU) 2017/1939 of 12 October 2017 implementing enhanced cooperation on the establishment of the European Public Prosecutor's Office ('the EPPO'), or on Directive (EU) 2017/1371 of 5th July 2017 on the fight against fraud to the Union's financial interests by means of criminal law, which defines the EPPO's subject matter jurisdiction. However, it is now possible to focus on how the EPPO works in practice and what obstacles it faces. In initial research, experts have identified several potential challenges that the EPPO will have to face. Now, after more than three years of operation, it is possible to see whether they were wrong in their predictions. The aim of this dissertation is therefore to answer the question of whether and how the EPPO has dealt in practice with the potential problems and ambiguities that have been identified in the past. To this end, the research is divided into five main areas, which are organisational issues, lack of harmonisation of criminal law, review of acts, cross-border investigations and external judicial cooperation.
