Institut celostátního referenda v ústavním systému České republiky Abstrakt V České republice bylo předloženo více než 40 návrhů ústavních zákonů usilujících o zavedení nějaké podoby celostátního referenda. Předmětné návrhy však poskytují jen strohá či dokonce žádná vysvětlení pro konkrétní navrhované právní podmínky a jen zřídka se zamýšlí nad možnými dopady, které by takový institut mohl přinést. Tato práce se pokouší podat strukturovaný přehled ústavních pravidel a principů vyplývajících z ústavního pořádku České republiky, kterými bychom se měli řídit při koncipování institutu obecného celostátního referenda, jakož i konkrétních zákonných podmínek, které upravují proces referenda, tj. předmětu referenda, binarity či mnohosti možností, iniciačního procesu, referendové kampaně, kvóra, volebního systému, (ne)závaznosti a (ne)opakovatelnost referenda a různých dalších souvisejících podmínek. Přitom identifikuji řadu nedostatků dosavadních návrhů zavedení referenda a poskytuji alternativní řešení k těm řešením, která zákonodárci dosud předkládali. Tvrdím, že referendum - pokud vůbec má být zakotveno v ústavě - by mělo dát lidem skutečnou možnost volby a mělo by mít přímý právní účinek (přijetí zákona). Bohužel, většina dosavadních návrhů se snaží omezit substantivní volbu i proces deliberace, a často se... 1 The institution of the national referendum in the constitutional system of the Czech Republic Abstract There have been more than 40 constitutional bills attempting to implement some form of a national referendum in the Czech Republic. These bills, however, provide little to no explanation for the specific legal conditions proposed and seldom reflect on the possible consequences such an institution might bring. This thesis is attempting to give a structured overview of both the constitutional rules and principles arising from the constitutional order of the Czech Republic which we should be guided by when designing the institution of a general national referendum, as well as the specific legal conditions that regulate the referendum process, i.e. the subject matter of the referenda, binarity or multeity of options, the initiation process, referendum campaign, quorum, the electoral system, (non)binding effect and the (non)repeatability of referendum and various other related conditions. In doing so, I identify a series of inadequacies of the previous referenda bills and give alternative solutions to those presented by the legislators so far.
