Obsah požívacího práva Abstrakt Práce se zabývá obsahem požívacího práva, tedy jeho podstatou. Vymezuje jej na základě analýzy práv a povinností jak poživatele, tak holého vlastníka. Blíže se věnuje otázce související s zásadou salva rerum substantia a jejím významem pro požívání jako takové. Ukazuje, že tato zásada se uplatní jako limitace pro poživatele v požívání. Dále se práce věnuje povinnosti poživatele věc udržovat a dává ji do kontextu právě s povinností věc udržovat. Předkládaná práce vymezuje jednotlivá práva poživatele a taktéž jeho povinnosti, které mu plynou ze zákona. Podrobněji se dále věnuje povinnosti poživatele věc po požívání předat. Neopomíjí zvláštní postavení poživatele v případě požívacího práva ke zuživatelným zastupitelným věcem a jistině uložené na úrok. Také se obdobně věnuje právům a povinnostem holého vlastníka, především ve vztahu k předmětu požívacího práva a k poživateli. V mnoha ohledech práce přináší do české právní vědy nové poznatky ohledně institutu požívacího práva. Vymezuje blíže termíny substance a formy ve vztahu k požívání, věnuje se otázkám detence v souvislosti s požívacím právem. Vymezuje rozsah a obsah požívání a dovozuje pro poživatele limity, které nesmí v požívání překročit. Práce vymezuje jednotlivé druhy požívacího práva a charakterizuje jejich znaky.... The Substance of the Right of Usufruct Abstract This thesis deals with the content of the right of usufruct, i.e. its substance. It defines it on the basis of an analysis of the rights and obligations of both the usufructuary and the bare owner. It looks more closely at the issue of the principle of salva rerum substantia and its significance for usufruct as such. It shows that this principle applies as a limitation on the usufructuary's enjoyment of the thing. The thesis then turns to the duty of the usufructuary to maintain the thing and puts it in context with the duty to maintain the thing. The present work defines the individual rights of the usufructuary and also his obligations under the law. It also looks in more detail at the duty of the usufructuary to hand over the thing after the usufruct is over. It does not overlook the special position of the usufructuary in the case of a usufruct over fungible fungible things and principal deposited at interest. It also deals similarly with the rights and obligations of the bare owner, particularly in relation to the subject-matter of the usufruct and the usufructuary.
