TY - THES TI - Identifikace klienta na dálku TT - Non-face-to face customer identification AU - Farny, Adam AB - Tato práce se zabývá rozborem české právní úpravy identifikace klienta jakožto základní povinností vyplývající z regulace boje proti legalizaci výnosů z trestné činnosti a financování první povinností, se kterou se klient při využívání služeb poskytovaných povinnou osobou setká a tak způsob, jakým právní úprava k identifikaci klienta přistupuje, přímo ovlivňuje průběh první interakce klienta s povinnou osobou. Téma je tak široce diskutované, protože hladký průběh onboardingových procesů je pro mnoho povinných osob, a zejména pro FinTech startupy, klíčový. Neoptimální regulace pro ně znamená zbytečnou zátěž a nepřímo je znevýhodňuje oproti zahraniční konkurenci, která může podléhat přívětivější regulaci. Zájem povinných osob na hladký průběh identifikace však může narážet na zájem regulátora zajistit co nejdůvěryhodnější výstup identifikace. Nalezení vhodného způsobu a vyvážení obou zájmů proto představuje pro zákonodárce ejíž vyřešení závisí na správném nastavení právní úpravy, která bude schopna udržet krok s technologickým pokrokem v této oblasti a která bude umožňovat využití těch nejlepších dostupných způsobů provedení identifikace. Cílem této práce je tak českou právn tímto účelem poskytuji v práci ucelený přehled procesu identifikace, vysvětluji jeho roli v kontextu opatření proti praní špinavých... AB - Non-face-to-face customer identification The subject matter of this thesis is the analysis of the Czech legal regulation of customer identification as a core obligation arising from the regulation of the fight against money laundering. Customer identification is the first obligation that a customer encounters when using the services of obliged entities, and thus the way in which the legislation approaches customer identification directly influences the course of the customer's first interaction with the obliged entity. The topic is widely discussed because smooth onboarding processes are crucial for many obliged entities, and FinTech startups in particular. Sub-optimal regulation imposes an unnecessary burden on obliged entities and indirectly puts them at a disadvantage against foreign competitors who may be subject to more favorable regulation. However, the interest of obligated entities may collide with the regulator's interest in ensuring the most trustworthy identification output. Finding an appropriate way for balancing interests of both sides therefore poses a considerable challenge for the legislator.
