Předkládaná diplomová práce se zabývá problematikou právní úpravy obnovitelných zdrojů energie se zaměřením na právní úpravu a systém podpory v České republice. Práce obsahuje také přehled dokumentů a nástrojů na úrovni práva mezinárodního. Z důvodu členství České republiky v Evropské unii se tato práce zabývá i nástroji, které poskytuje unijní úprava, která skrze sjednocování právních úprav členských států a vytyčování závazných cílů směřuje k jednotnému, otevřenému a liberálnímu energetickému trhu. Práce stopuje historický vývoj tohoto fenoménu od prvotních dílčích právních úprav až po úpravy komplexní a sofistikované, včetně uměle vytvořených systémů podpor a dává je do souvislostí se sociálně-ekonomickými aspekty sledovaného časového období. Díky užití komparativní metody práce přináší nejenom srovnání právních úprav tak, jak následovaly v čase na úrovních Evropské unie a České republiky, ale současně je také hodnotí a snaží se u vybraných institutů odhadnout další vývoj a poskytnout i možné způsoby řešení. Jedním z cílů této práce je poskytnout pohled na právní úpravu obnovitelných zdrojů energie z pozice podnikatele a uvést tento vztah v souvislosti s institutem ochrany životního prostředí. Title: Legislation of renewable energy sources and their use Abstract The presented thesis deals with issues of legal regulation of renewable energy sources with target on legal regulation of system of support in the Czech Republic. The thesis contains the overview of documents and instruments from international enviroment. As a result of the Czech Republic membership in the European Union the thesis presents instruments of union legislation which due to integration of EU member states legislation and due to marking out obligatory goals aims to opened unified and liberal energy market. The thesis describes historical development of this phenomenon from partial legislation to complex and sophisticated legislation and artificially formed systems of support including and puts them into context with social economic aspects of pursued period of time. Due to comparative method the thesis brings not only comparation of legislation in the course of time in Czech and European background but also evaluate them and try to estimate progress and find possible solution. One of the thesis targets is to provide the comprehensive view on legislation of renewable energy sources from businessmen points of view and put this relationship into context with institute of environment protection.
