1 Resumé Účelem této práce je vymezení a zamyšlení se nad příčinami a právními formami omezování vlastnického práva k půdě. Vzhledem k tomu, že vlastnické právo k půdě a jeho omezení vychází jak z práva soukromého, tak z práva veřejného, je toto téma spojeno téměř se všemi obory práva našeho právního řádu. Tato práce se skládá ze čtyř částí. První část je úvodní a popisuje celkový obsah, o kterém pojednává tento dokument. Část druhá vymezuje základní pojmy, jejichž znalost je nutná pro celou tuto práci. Jedná se o tyto pojmy: vlastnické právo, pozemek, parcela, nemovitost a vlastnické právo k půdě. Tato část je rozdělena do tří kapitol. První kapitola popisuje vlastnické právo jako jedno z lidských práv, jehož ochranu zajišťují dokumenty mezinárodního práva a LZPS, ze které vychází i další právní úprava na zákonné úrovni. Další kapitola se zabývá zvláštnostmi půdy - těmi jsou polyfunkční charakter, nepostradatelnost, omezená rozloha, nerozmnožitelnost, nepřenositelnost, neopotřebitelnost a nespotřebitelnost, to, že není produktem lidské činnosti, ale přírody. Tato kapitola dále vysvětluje další příbuzné právní pojmy. Poslední kapitola této části pojednává o vlastnickém právu k půdě, konkrétně o jeho předmětu, možných subjektech a jeho obsahu. Třetí část se soustředí na samotnou podstatu tohoto textu, tedy... 1 Abstract Reasons for and legal forms of the restriction of land ownership rights The purpose of my thesis is to analyse the reasons for and the legal forms of the restriction of land ownership rights. Because the land ownership rights relate to both the private law and the public law, this theme is linked with almost all fields of our legal order. The thesis consists of four chapters. Chapter One is introductory and describes the content the paper is about. Chapter Two defines basic terminology used in the thesis: the proprietary rights, the land, the allotment, the real property and the proprietary rights to land. The chapter is subdivided into three parts. Part One describes proprietary right as one of the human right, which is protected by international conventions and the Declaration of basic rights and freedom. Part Two deals with the land specialities - such as the multifunctional character, the indispensableness, the limited extent, the impossibility of multiplication, the impossibility of placing the land elsewhere, the everlasting existence, the impossibility of consumption and the natural, not human origin.
