1 Abstrakt V předkládané disertační práci jsem se pokusil obhájit názor, že chceme-li v situaci kolize základních práv anebo kolize základního práva a veřejného zájmu správně aplikovat princip proporcionality, nestačí na něj v rámci argumentace pouze odkázat, nýbrž je třeba podrobně poznat jeho strukturu a aplikovat jeho jednotlivé složky. Abychom mohli poznat strukturu a složky principu proporcionality, je zapotřebí rozumět postavení a účinkům základních práv v právních řádech. Domnívám se, že teoretické základy principu proporcionality přispívají k lepšímu pochopení objektivního napětí mezi autonomií jednotlivce a obecnou vůlí společenství. Další významný prvek při správné aplikaci tohoto principu lze spatřovat v institucionální rovnováze zákonodárství a justice a překonávání "protivětšinového problému" rozhodování soudů. V současné, nejen české, právní praxi můžeme sledovat řadu příkladů, v nichž soudy nekladly na princip proporcionality náležitou pozornost, a v lepším případě na něj při řešení obtížných případů aplikace práva pouze obecně poukázaly. Ze všech výše uvedených důvodů se domnívám, že má význam budovat metodologii principu proporcionality. V první kapitole této práce je princip proporcionality vymezen a dán do souvislosti s dalšími hodnotami v právu, především s hodnotou spravedlnosti a... 1 Abstract (in English langugage) In the presented dissertation thesis I tried to argue that if we want to apply the principle of proportionality correctly in case of a collision of fundamental rights or in case of a collision between a fundamental right and a countervailing interest, it is not sufficient only to refer to this principle within the argumentation. On the contrary, it is necessary to recognize a structure of this principle and to apply its components. In order to recognize the structure and components of the proportionality principle, it is necessary to understand the role and effects of human rights in legal orders. I assume that theoretical backgrounds of this principle contribute to the better understanding of the objective tension between the individual's autonomy and general will of the society. Another important aspect in the correct application of this principle is the institutional balance between the legislature and the judiciary and overcoming of the "counter-majoritarian problem". In the contemporary, not only Czech, but also foreign practice we may observe lots of examples in which courts do not pay appropriate attention to the proportionality principle.
