Alternativy nepodmíněného trestu odnětí svobody Abstrakt Tato diplomová práce se zaměřuje na alternativy nepodmíněného trestu odnětí svobody. Úvodní část zahrnuje kapitoly zabývající se pojmem trestu, konceptu restorativní justice a činností Probační a mediační služby. Dále jsou v této části samostatné kapitoly, které se věnují systému alternativních opatření, alternativním trestům, vývoji alternativních opatření v právní úpravě. Vzhledem k účelu práce je zmíněna ve stručnosti problematika nepodmíněného trestu odnětí svobody. Stěžejní část práce se zabývá vybranými alternativními tresty, konkrétně podmíněným odsouzením, podmíněným odsouzením s dohledem, trestem domácího vězení, trestem obecně prospěšných prací, peněžitým trestem a trestem zákazu vstupu na sportovní, kulturní a jiné společenské akce. Jednotlivé kapitoly se blíže věnují konkrétnímu alternativnímu trestu z hlediska jeho právní úpravy a následnému výkonu a realizaci v praxi. Podrobně jsou rozebírány a de lege ferenda řešeny jak výhody, tak úskalí, kterým čelí. klíčová slova: alternativní opatření, alternativní tresty, restorativní justice The alternatives to unconditional sentence of imprisonment Abstract This thesis focuses on the alternatives to unconditional sentence of imprisonment. The introductory part includes chapters dealing with the concept of punishment, the concept of restorative justice and the activities of the Probation and Mediation Service. Furthermore, there are separate chapters in this part, which deal with the system of alternative measures, alternative sanctions, the development of alternative measures in legislation. In relation to the purpose of the work is mentioned briefly the issue of unconditional sentence of imprisonment. The main part of the thesis deals with selected alternative sanctions, namely conditional sentence, conditional sentence with supervision, house arrest, a sentence of community service, financial penalty and prohibition to enter the sport, cultural and other social events. The individual chapters deal in more detail with a specific alternative sanction in terms of its legal regulation and subsequent execution and implementation in practice. Both the advantages and disadvantages they face are discussed in detail and de lege ferenda addressed. key words: alternative measures, alternative sanction, restorative justice
