Obsahem předkládané diplomové práce je představení vybraných institutů práva politických stran a jejich úpravy v České republice a Spolkové republice Německo. Práce je dělena do dvou kapitol. První z nich se dotýká základních otázek právní úpravy politických stran v obou státech, druhá poté financování politických stran. Jelikož se jedná o diplomovou práci komparativní, jsou v prvních dvou podkapitolách vždy představeny jednotlivé právní úpravy. Ve třetí podkapitole jsou nejvýznamnější instituty srovnány a je navrženo jejich možné užití v českém právním řádu. Stěžejními body první kapitoly jsou především proces vzniku politických stran, srovnání zakotvených atributů obranyschopné demokracie v právních řádech a v neposlední řadě také zamyšlení nad možným rozšířením adresátů práva dle. čl. 20 odst. 2 Listiny základních práv a svobod, tvořit a sdružovat se v politických stranách a politických hnutích, také na cizince, kteří se dlouhodobě zdržují v České republice. Druhá kapitola této práce se věnuje aktuálnímu tématu, které je součástí politického života od jeho počátku - tedy financování politických stran. Oba srovnávané státy prošly v této oblasti dlouhým vývojem, který ovšem nikdy nebude možné považovat za ukončený. Strany budou ke své činnosti vždy potřebovat finanční prostředky a ty se budou... The content of the presented thesis is the introduction of selected institutes of the laws on political parties and their enactment in the Czech Republic and the Federal Republic of Germany. The thesis is divided into two chapters. The first addresses the fundamental questions of the legal regulations on political parties in both countries. The second deals with the funding of political parties. Because this is a comparative thesis, individual legal regulations are always introduced in the first two subchapters. The third subchapter compares the most significant institutes and their possible use in the Czech law is proposed. The main points of the first chapter are especially the process of political party creation, the comparison of anchored attributes of a democracy capable of defence in the laws and last but not least also the contemplation of the possible expansion of the addressees of the right to form and join political parties and political movements, pursuant to Article 20 par. 2 of the Charter of Fundamental Rights and Freedoms, also to foreigners staying in the Czech Republic for a long time.
