1 Anotace Tato práce se zabývá ochranou investic v Evropské unii, a to z několika úhlů pohledu. První část práce pojednává o historii ochrany investic a jejích hlavních východiscích a základech pro současnou právní úpravu a pro návrhy budoucí úpravy, zejména v rámci EU. V dalších částech je pak podrobně analyzována současná právní úprava a nastavení ochrany investic v EU, přičemž je posouzena i otázka platnosti a aplikovatelnosti tzv. intra-EU BITs, tj. bilaterálních dohod uzavřených mezi dvěma členskými státy EU. Analýza je provedena jak prizmatem práva Evropské unie, tak z pohledu mezinárodního práva. Práce se dále věnuje jejich vzájemnému vztahu a demonstruje rozpory mezi nimi na dvou klíčových kauzách Eureko/Achmea a Micula. Dalšími tématy, jimiž se tato práce zabývá, jsou pravomoci Evropské unie na poli ochrany investic a sjednávání mezinárodních dohod, jako jsou například CETA nebo TTIP. Práce dále pojednává o statutu, pravomoci a fungování Mezinárodního střediska pro řešení investičních sporů ICSID, na kterém ukazuje relativně bezproblémový a široce akceptovaný systém řešení investičních sporů. V návaznosti na to je analyzován plánovaný projekt investičního soudu Evropské unie, včetně jeho kritického zhodnocení a doporučení pro další směřování ochrany investic v EU a efektivního systému řešení sporů... 1 Abstract This dissertation deals with investment protection in the European Union from several points of view. The first part deals with the history of investment protection and its main basis and grounds for current legislation and proposals for future regulation, particularly within the EU. In subsequent parts, current legislation and intra-European Union investment protection is analysed in detail, including the question of validity and applicability of Intra-EU BITs, i.e. bilateral treaties concluded between two EU Member States. The analysis is made from the perspective of EU law, as well as from the point of view of public international law. The dissertation further deals with their relationship and demonstrates contradictions between them in two crucial cases, Eureko/Achmea and Micula. Additional themes of this dissertation are the powers of the European Union regarding investment protection and the conclusion of international treaties such as CETA and TTIP. This dissertation further deals with the status, jurisdiction and functioning of the International Centre for Settlement of Investment Disputes (ICSID), demonstrating the relatively smooth and widely accepted investment dispute settlement mechanism.
