(CZ) Tato práce se snaží blíže analyzovat princip vyčerpání autorských práv zejména ve vztahu k počítačovým programům v komparativním kontextu právní úpravy EU a USA. Otázka vyčerpání autorských práv k počítačovým programům se stala aktuální zejména po rozhodnutí Soudního dvora Evropské unie (SDEU) v případu UsedSoft v. Oracle, v němž SDEU dovodil, že tento princip platí nejen u počítačových programů prodávaných na hmotných nosičích, ale též u počítačových programů distribuovaných v digitální podobě prostřednictvím Internetu. Tento závěr byl nicméně odbornou veřejností přijat značně kriticky, když SDEU ve svém rozhodnutí akcentoval spíše ekonomické argumenty než evropskou právní úpravu a znění mezinárodních úmluv. Na určité problémy poukázalo i zcela opačné rozhodnutí soudu v USA v případu Capitol Records v. ReDigi, v němž soud přesvědčivě shrnul právně-technické důvody, proč se tento princip v kontextu stávající právní úpravy nemůže na prodej digitálních souborů distribuovaných prostřednictvím sítě Internet použít. V první části práce se zabývám vymezením pojmu počítačový program a jeho začlenění mezi předměty chráněné autorským zákonem. Druhá část je zaměřena na stručnou charakteristiku systému autorských práv (resp. systému copyright) v rámci EU a USA. Třetí část pak představuje určitý úvod do... (EN) The aim of this thesis is to provide an analysis of the principle of exhaustion of rights especially to computer programs in the comparative context of the legal regulation in the EU and US. The issue of exhaustion of rights to computer programs became a topical problem after the decision of the Court of Justice of the European Union (CJEU) in case UsedSoft v. Oracle, when the CJEU ruled that the principle of exhaustion of rights is applicable not only for sale of computer programs on tangible media such as CD/DVD, but also for distribution of computer programs in digital form via Internet. This decision, however, became widely criticized by legal experts, since CJEU accented rather economic arguments in favor of this principle than the European legal regulations and international conventions. Certain problematic aspects were also demonstrated in the decision of US court in case Capitol Records v. ReDigi, in which the court persuasively summarized legal and technical reasons why the principle of exhaustion of rights cannot be applicable for the sale of digital files distributed via Internet in the context of current legal regulation.
