práce v českém jazyce Cílem této mé práce je uvést a následně blíže rozebrat dva z nově, respektive po dlouhé době opětovně zavedených institutů dědického práva, a to dědické smlouvy a odkazu. Vzhledem k tomu, že smrt je přirozenou právní skutečností, jež nutně postihne každého z nás, přičemž zejména s přibývajícím věkem mnoho z nás dosti důkladně zvažuje, komu mortis causa "odkázat" majetek nabytý za života, měl by se každý, kdo takto uvažuje, má-li zároveň zájem vyhnout se zákonné dědické posloupnosti, seznámit s těmito novými a dle mého názoru velmi praktickými instituty. Celá tato práce je rozdělena do šesti kapitol (včetně úvodu a závěrečného shrnutí). Stěžejními částmi práce jsou potom kapitola druhá až čtvrtá zabývající se nejprve jistým úvodem do celé problematiky a osvětlením základních pojmů, po čemž následuje rozbor institutů dědické smlouvy a odkazu, včetně komparace s vybranými zahraničními právními úpravami, a výklad týkající se historie obou zmíněných institutů. Samotné kapitoly zabývající se dědickou smlouvou a odkazem jsou rozděleny do podkapitol tak, aby byly rozebrány veškeré jejich aspekty; u institutu dědické smlouvy tedy její stručná charakteristika, forma, problematika smluvních stran a předmětu dědické smlouvy, včetně problematiky doložek času a podmínek, na což navazuje... práce v anglickém jazyce Aim of this work is to introduce and then closely describe two of new, or better to say re-established institutes of law of succession - contract of succession and legacy. Because death is a natural legal fact that none of us avoids which results in a fact that most of us, especially with increasing age, think thoroughly whom to bequeath property acquired during his/her life, everyone who ponders in such a way in case he/she wants to avoid intestate succession should have a knowledge of these new institutes, in my opinion very practical ones. The whole work is divided into six chapters (including introduction and conclusion). Chapters two to four are the principal chapters of this work dealing first with some kind of introduction into the whole problematics by explanation of basic terms, which is followed by interpretation of the institute of contract of succession and legacy, including comparison with chosen foreign legislations, as well as history of both mentioned institutes. The chapters dealing with contract of succession and legacy are divided into subchapters so that all aspects of these institutes could be explained; concerning contract of succession it is its short characteristics, form, problematics of time clauses and conditions, which is followed by the matter...
