Resumé - Azyl a uprchlictví ve světle judikatury Evropského soudu pro lidská práva Práce se zabývá problematikou azylu a uprchlictví v kontextu Úmluvy o ochraně lidských práv a základních svobod z roku 1950 a judikatury Evropského soudu pro lidská práva. Jejím cílem je poukázat na úzké propojení uprchlického práva s ochranou lidských práv. Text práce je členěn do sedmi kapitol. Po úvodním rozlišení pojmů azyl a uprchlictví je představena definice uprchlíka obsažená v klíčovém instrumentu mezinárodního uprchlického práva - v Úmluvě o právním postavení uprchlíků z roku 1951. Práce se definici uprchlíka věnuje skrze její inkluzivní, cesační a exkluzivní klauzuli. Následně je popsána zásada non-refoulement, vyjádřená v článku 33 Úmluvy o právním postavení uprchlíků, která zakazuje státům vyhostit a navrátit uprchlíka do země, kde by jeho život nebo osobní svoboda byla ohrožena. Další výklad se zaměřuje na Úmluvu o ochraně lidských práv a její kontrolní mechanismus v podobě Evropského soudu pro lidská práva. V této části je rozebrána procedurální stránka vyřizování stížností na porušení úmluvy. Jádrem práce je její šestá kapitola, která je rozdělena na dílčí podkapitoly podle relevantních ustanovení Úmluvy o ochraně lidských práv. Jsou zde představena pro problematiku azylu a uprchlictví významná rozhodnutí... - Asylum and refugees in the light of the case law of the European Court of Human Rights The thesis deals with issues of asylum and refugees in the context of the Convention for the Protection of Human Rights and Fundamental Freedoms and the case law of the European Court of Human Rights. The purpose of the thesis is to show a tight relationship between refugee law and protection of human rights. The text is divided into seven chapters. In the introduction, the terms asylum and refugees are distinguished and a refugee is defined according to the crucial document of international refugee law, the Convention relating to the Status of Refugees. The definition of a refugee is outlined using inclusion, cessation and exclusion clauses. The next chapter is dedicated to the rule of non-refoulement stated in the Article 33 of the Refugee Convention, which prohibits states from expelling and deporting a refugee back to a country, where his life or freedom is threatened. The following part focuses on the European Convention on Human Rights and its surveillance done by the European Court of Human Rights. This part also examines the procedural issues of dealing with complaints on breach of the European Convention on Human Rights.
