[cze][eng] RESUMÉ SMLUVNÍ PRÁVO AUTORSKÉ Diplomová práce se věnuje právu nehmotných statků, konkrétně autorskému právu. Zpracovává téma smluvních institutů v českém autorském právu. Těžiště práce pak leží na popisu a rozpoznání přístupu k autorském právu podle posledních dvou platných českých autorských zákonů. Konkrétně se jedná o zákon č. 35/1965 Sb. a o zákon č. 121/2000 Sb. Práce se soustředí na popis a vysvětlení těch částí autorských zákonů, které se zabývají smluvním právem, tedy oprávněním autora poskytnout právo dílo užít. První kapitola se zabývá prameny českého smluvního autorského práva od ústavních zákonů až po předpisy nižší právní síly (vyhlášky). Druhá a třetí kapitola slouží k seznámení se základními koncepty práva nehmotných statků, s důrazem na specifika autorského práva. Součásti práce je i stručný výklad nejdůležitějších pojmů a definic. Čtvrtá kapitola stručně popisuje historii a vývoj autorského smluvního práva na českém území. Jednotlivé autorské zákony jsou představeny s ohledem na jejich důležitost pro smluvní právo a kontinuitu vývoje. Pátá kapitola představuje důkladnou sondu do ustanovení smluvního práva v autorském zákoně č. 35/1965 Sb. Smluvní právo je vykládáno s ohledem na společenské změny, ke kterým došlo v průběhu jeho platnosti. Šestá kapitola zkoumá současný autorský zákon č....CONTRACTUAL COPYRIGHT LAW This thesis is dedicated to the Czech Copyright Law, which is part of Intellectual Property Law. The core of this work is lying on description and recognition of contractual concepts of Copyright Law in Czech Republic, namely the last two Copyright Acts. The first Copyright Act was valid from 1965 till 2000. The second Copyright Act is effective since 2000. Chapter 1 covers the sources of Czech Contractual Copyright Law on different levels, from the constitutional grounds to the regulations. Chapters 2 and 3 are initial introduction to the Intellectual Property Law. It provides basic explanation of intangible property terms. Chapter 4 tries to briefly show the history and the development of the Copyright Law on the Czech territory, particularly Czech Contractual Copyright Law. Chapter 5 deals with provisions of Copyright Act 35/1965. It concentrates on contracts for the distribution of a work and contracts to produce a work. Chapter 6 is devoted to the effective czech Copyright Act 121/2000 and its provisions related to contractual law. With short notice about contract for a work done. Chapter 6 compares some important attributes of both mentioned Copyright Acts.
