[cze][eng] Ve své rigorózní práci jsem se věnovala právní úpravě věcných břemen a sousedských práv, jakožto institutů vzájemně souvisejících. Úvodní pasáže objasňují oba zásadní pojmy této práce, tedy věcná břemena a sousedská práva s ohledem na současnou právní úpravu, jakož i jejich vzájemný vztah. Lepšímu pochopení současného zakotvení obou institutů v občanském zákoníku napomůže krátký výklad o historické právní úpravě obou institutů na našem území od počátku 19. století do současnosti. Při vymezení věcných břemen a sousedských práv a rozboru jejich zakotvení v současném českém právním řádu jsem se pokusila do své práce začlenit konkrétní případy nejčastěji zřizovaných věcných břemen jakož i v praxi velmi časté případy porušení sousedských práv. V další části rigorózní práce jsem se věnovala právním instrumentům sloužícím k ochraně práv odpovídajících věcným břemenům a sousedských práv tak, jak jsou zakotveny v občanském zákoníku. V poslední části této práce následuje stručné pojednání o právní úpravě věcných břemen a sousedských práv ve Spolkové republice Německo, zejména tak jak je zakotvena v německém občanském zákoníku. V rámci pojednání o jednotlivých druzích zásahů do sousedských práv dle německého práva jsem se pokusila rovněž o krátké srovnání institutu imisí s právní úpravou zakotvenou v českém občanském...In my doctoral thesis I have focused on legal regulation of easements and rights of neighbours as interrelated legal institutes. The introductory passages illustrate both fundamental concepts of this work, namely easements and rights of neighbours with regard to the current legal regulations, as well as their mutual relation. A short presentation of the historic legislation of both institutes in our territory since the early 19th century until today might help better understanding of the actual legal regulation of these institutes in Civil Code. By determination of easements and rights of neighbours and by analysis of their establishment in current Czech law I attempted to incorporate in my work the actual cases of the most frequently established easements, as well as very common violations of neighbourhood rights. Another part of my thesis is devoted to legal instruments serving to protect the rights corresponding the legal regulation of easements and rights of neighbours in Civil Code. Last section of the thesis contains a brief treatise on the law of easements and rights of neighbours in the Federal Republic of Germany, particularly as codified in the German Civil Code.
