Závěr Přestože Česká inspekce životního prostředí byla prvním dozorovým orgánem státní správy s celostátní působností na úseku ochrany životního prostředí, zanedlouho si mezi ostatními orgány státní správy vydobyla nenahraditelné postavení. Je to dáno především jejím odborným zaměřením, které je mnohdy využíváno i jinými orgány státní správy v rámci žádostí o poskytnutí odborné pomoci ze strany Inspekce. Hlavní náplní činnosti ČIŽP je dohled nad dodržováním právních předpisů a závazných rozhodnutí správních orgánů v oblasti životního prostředí, který je prováděn pomocí kontrol a revizí na konkrétních místech. Inspekce byla zřízena jako kontrolní orgán, přesto má stále v kompetenci oblasti, které s inspekční činností naprosto nesouvisí. Je to dáno nesystematičností zákonných úprav a stále rostoucími nároky na rozsah dozorové činnosti Inspekce, které je velmi složité uspokojovat i z důvodu zatížení inspektorů právě v souvislosti s nedozorovými činnostmi. Těmito nedozorovými činnostmi jsou pravomoci související s výměrou poplatků dle VodZ106 a určité schvalovací pravomoci dle OvZ.107 Domnívám se, že tyto pravomoci mají spíše administrativní charakter, proto by bylo vhodné je z činnosti Inspekce vyčlenit a tím deklarovat, že ČIŽP je specializovaným orgánem kontrolním. Zároveň by bylo žádoucí přenést činnost...The Czech Environmental Inspectorate The Czech Environmental Inspectorate is a professional body of state administration, which is charged with supervision of observing the statutory norms in the field of the environment. It was established in 1991 by the Act No. 282/1991 Collection of Law, on Czech Environmental Inspectorate and its competencies in forestry protection, as a body subordinate to the Department of the Environment. The inspectorate exercises its activities in five areas, namely the climate, water, nature, landscape and forestry protection and waste management, and also in the area of integrated prevention. In course of time, the Czech Environmental Inspectorate has also taken the protection of the ozone layer into its sphere of action, as well as the supervision over the chemical agent treatment and the questions of packaging and genetically modified organisms. Its main tasks are the control, revision and research on specific places. The competencies of the Czech Environmental Inspectorate are regulated by the above mentioned law and simultaneously, by individual component laws.
