[cze][eng] Tato práce pojednává o fenoménu lobbingu, který vstoupil spolu s pluralitní, zastupitelskou demokracií do českého kulturního prostředí teprve nedávno. Tento fenomén tedy nemá potřebnou tradici a stále naráží na nevyjasněné chápání jeho funkce českou laickou veřejností. Tato práce je koncipována tak, aby nejprve odpověděla na otázku kde se lobbuje, jak se lobbuje a kdo lobbuje. Poslední uvedená kapitola je komparací rozdílného lobbingu neziskových a ziskových organizací. Tyto dvě hlavní skupiny podílející se na rozhodování skrze svého představitele předkládají své zájmy a často i analýzu dopadů určitého přijatého zákona na oblast svých zájmů politikům. Situace v České republice však není lobbingu nakloněna a tento bývá automaticky spojován s korupcí. Výsledkem této práce by mělo být poznání, že je-li lobbing vymezen, institucializován a regulován, nemusí být spojován a priori se skrytou korupcí či manipulací s veřejným zájmem. Možné způsoby regulace ukazuje na příkladech systému regulace dobrovolným kodexem mající domov ve Velké Británii a systému normativní regulace zákonem, jehož příkladem je systém ve Spojených státech amerických. Z příkladu těchto zemí i dalších vyvozuji závěr, že rozdílné systémy regulace vycházejí z rozdílných kulturních systémů, a zvláště pak z jejich rozdílných systémů působení...This thesis deals with the phenomena of lobbyism which has entered Czech cultural background together with pluralistic, representative democracy late in recent years. This feature has not a necessary tradition and it is still confronted with vague understanding of his function by Czech laic community. This thesis is outlined thus to first answer the questions where is lobbing held, how is it proceed and who are the groups which are lobbing. Last mentioned chapter is comparison of the different lobbing of non-profit and profit organizations, which are the main participation groups on decision making through their representative - the lobbyist, who presents interests of the group and often also the possible impacts of this particular law on their fields of interests to politician. The situation in Czech Republic is not conciliated to lobbing. The aim of this thesis is the recognition that if lobbing is defined, established and regulated does not need to be accompanied with hidden corruption and manipulation with public interest. The possible models of regulation are demonstrated on system of regulation by the facultative codex in Great Britain and the system of normative regulation by law in United States of America.
