Tato bakalářská práce se zabývá otázkou formování státnosti z hlediska mezinárodního práva jedné ze současných sporných entit usilujících o státnost -- Palestiny. Teoretická část vychází z Montevidejské úmluvy z roku 1933 definující znaky státu jako subjektu mezinárodního práva, dále se zaměřuje na právo na sebeurčení národů, vznik a uznání státu s jeho důsledky. Jednotlivá kritéria státnosti jako obyvatelstvo, území, vláda a schopnost vystupovat v mezinárodních vztazích jsou pak v navazující empirické části rozebrány a aplikovány na příklad Palestiny. Cílem práce je posoudit, zda jsou kritéria státnosti uvedená v teoretické části naplněna či co naplnění brání. Snaží se zaměřit na analýzu utváření znaků státnosti zejména v historickém kontextu. Třetí kapitola se věnuje roli významných mezinárodních aktérů při formování palestinských znaků státnosti a jejich aktuálním postojům k otázce Palestiny. Práce přispívá ke zpřehlednění a lepšímu pochopení problematiky palestinské státnosti a nabízí komplexní pohled na její postupné utváření a vývoj. The bachelor thesis deals with the creating of statehood under international law of one of the current controversial entities striving for statehood - Palestine. The theoretical part is based on Montevideo Convention of 1933 which defines the characteristics of the state as a subject of international law, it focuses also on the self-determination right of nations, the creation and recognition of the state with its consequences. Individual criteria of statehood such as population, territory, government and capacity to act in international relations are analysed in the empirical part and then applied to the example of Palestine. The aim is to evaluate whether the criteria of statehood set in the theoretical part are fulfilled or what prevents them from fulfillment. The thesis tries to focus its analysis on the creating of statehood characteristics especially in historical context. The third chapter is devoted to the role of major international players in shaping of Palestinian statehood characteristics and their current attitudes to the question of Palestine. The work contributes to the clarification and better understanding of the issue of Palestinian statehood and offers a comprehensive view of its piecemeal forming and development.
